PM Should Clear His Name In Court

A Kadir Jasin

In the name of God, the Most Gracious, the Most Merciful

LATEST, Nov 6 – The police today question Tun Dr Mahathir Mohamad at his Yayasan Albukhary Foundation’s office over statements against the country's leadership and other related issues including remarks he made at the Bersih 4 rally in August.

Speaking to reporters, he said he would leave it to the police to decide if he should be arrested.

Bravo the PDRM and the IGP!

OROGINAL POST

I HAVE resisted the temptation to comment on issues raised by the likes of (Datuk Seri Panglima) Salleh Said Keruak, (Datuk) Abdul Rahman Dahlan and (Datuk Seri) Mohd Nazri Aziz.

[REMINDER: No anonymous comments will be published.  Please use Google Account, OpenID or Name/URL. Pseudonym is accepted. Be respectful. No swearing. Thank you]

This is not because the issues they raised were uninteresting or irrelevant but rather the way they put forth their arguments baffles me. I am mortally fearful that their level of intellect far outstrips mine, being the country yokel that I am.

Furthermore, these men are extraordinary and plenipotentiary spokesmen of the Prime Minister, (Datuk Seri Mappadulung Daeng Mattimung Karaeng Sanrobone) Mohd Najib Abdul Razak.

But when the Sabahan Salleh wrote in his blog on Nov 2, saying that former Prime Minister, Tun Dr Mahathir Mohamad had made serious allegations that Mohd Najib Razak had sabotaged the country’s banking and finance systems but failed to offer solid explanation, temptation took the better of me.

The Sabah Factor: Mohd Najib, Musa Aman (Sabah CM) and Salleh

Either Salleh has not been reading what Dr Mahathir had written in his blog and said in public or if he did, he didn’t understand. If the latter is the case, I won’t blame Salleh.

He could have difficulty comprehending what Dr Mahathir (the Prime Minister for 22 years) had written and said because the latter wrote and spoke simply and precisely whereas Salleh, being Canadian-educated and all, may be more familiar with the Shakespearean English.

For the record, Salleh was for a short period the Chief Minister of Sabah under Dr Mahathir. Could he have an axe to grind with his former boss?

My peasant response to Salleh is this. If indeed Dr Mahathir is big on allegations but small on details, he should tell us who is big on details.

Ask PM to Go to Court

My layman’s hunch is that man is none other than Mohd Najib himself. SRC International and 1Malaysia Development Berhad are his creation and his corporate play.

If indeed Dr Mahathir allegations, which are shared by the majority of Malaysians, are indeed farcical, Salleh should prevail on the Prime Minister to clear his name in the court of law instead of groaning and moaning about being unfairly tried in the court of public opinion.

Presumably Salleh is influential with the Prime Minister. He should use that special relationship to advise Mohd Najib to either sue Dr Mahathir or instruct the Attorney General, (Tan Sri) Mohamed Apandi Ali to take the SRC International’s case to court.

Direct Apandi to charge Mohd Najib

Mohd Najib should have no problem submitting to the country’s judicial system in order to clear his name once and for all.

Surely he has enough faith in the country’s judiciary to give him a fair hearing. All that he and his brilliant lawyers have to do is raise reasonable doubt against the charge and he goes scot-free.

After all, only a few days ago that the Prime Minister’s Department (PMO) issued a statement defending the judiciary against the attack by the United Nations’ Working Group on Arbitrary Detention over its condemnation of the jailing of former Opposition Leader, (Datuk Seri) Anwar Ibrahim.

Even his lawyers want him to file a defamation suit against the Wall Street Journal (WSJ) in Malaysia instead of in the US, where the newspaper is based.

Leadership by Example

He should start the ball rolling by submitting himself to a Malaysian court to clear his name over the corruption allegations involving the RCI International’s money once and for all.

All that Mohd Najib’s believers like Salleh, Abdul Rahman, Mohd Nazri, (Datuk Seri) Ismail Sabri Yaakob, (Datuk) Azalina Othman Said, (Datuk) Ahmad Maslan and (Datuk) Dr Mohd Puad Zarkashi have to do is to ask him to instruct the AG to charge him with the SRC International case.

In that way he could clear his name and prove once and for all what a big liar Dr Mahathir is.

Isn’t that brilliant?

He would be killing three birds with one stone – clearing his name, discrediting Dr Mahathir forever and bringing back confidence in his administration, which his own brother said is lacking (read here).

I rest my case.

Wallahuaklam.

  7. DAKJ,

Rahman Dahlan was promoted from a Deputy Minister to Minister. Salleh Said Kruak, a former Sabah State Assembly's Speaker was made a Senator and then appointed Minister. Both the Sabahans have effectively made Ahmad Maslan an outcast, not only he still remains as Deputy Minister, he also lost his role as Najib's spokesman.

How else to express their gratitude to Najib, other than to continue barking and more often than not making statements that are preposterous or out of tangent. They are becoming more moronic as the days pass by.

  11. the right Sosma10:38 PM

I am sure everyone has tuned into Gani Patail's speech at the Bar Council forum on Sosma.

He also touched on the arrests and detention of Matthias Chang and Khairuddin.

He said Sosma was intended to deal with terrorists and terrorism and that making reports overseas does not warrant an arrest under the act.

"How does lodging a report and disclosing information about alleged mismanagement, misappropriation of funds, embezzlement or fraud constitute sabotage when the whole purpose was to enable the police or other law enforcement agencies to initiate investigation?

"What then of the protection of the whstileblowers and the Whistleblower Protection Act 2010? These are things you have to ponder," he added.

It is indeed very clear that both the men above were wrongly detained and wrongly charged under Sosma.

We call upon the judiciary to order their immediate release.

    "Malaysia - The Silent Majority"

-Its difficult for US ALL nowadays to "stay silent" but "still resisting" the 'unholiness' that is currently happening to Our Nation...

-For Us Malaysians, "To be Vocal" sometimes seems pointless.. "To be Quiet" also seems too irresponsible.. And "To be Neutral" is now seems even more 'damning' than ever..

-Like "Me, Myself & I".. Standing aside while trying to maintain observing, analyzing, comprehending, and researching, about "anything that is questionable" proves to be..somehow.."unbearable"

-Being "silent" can be very irritating..especially when it comes to "just watching without even trying" to defend 'The Truth'..to be "Righteous In Our Conduct"..

-May God Almighty consolidates us towards Righteousness... Ameeenn..

    "Malaysia - Hopelessly Losing Hope"

-For some of Us.. They where "looking happily forward" with the recent 19th October where Our Parliament once again commenced.. They where really hoping for some kind of "Unprecedented Actions"..

-Hoping that all Our Politicians will (for once at least) be 'Self-Less' and come together and "install" a better Malaysia...For Us All..

-But instead, Our Politicians remain "as themselves"..as usual..without even sincerely considering or even thinking about 'The Big Picture' - About Us Rakyat and the future of Our Anak2 Cucu2 Semua2..

-The very most is they carried placards asking about those billions...And as always, it all "goes down the drain".. Like nothing happened!

-So things now remains as it is... "Status-Quo - Malaysian Version"..

-Things/Goods remains expensive, GST remains aggressive, our Toll-Charges went sky-rocket, our Gov foolishly agreed to "the poisonous TPPA", our Bursa not quite stabilizing, our Ringgit not really improving... Our Nation's "good international reputation" losing percentage by the day.. Wow!!! That's "Status Quo - The Malaysian Version" !!

-May God Almighty strengthen us all in facing all these obstacles..

  14. DAKJ,

Unless he is dragged to court to face criminal charges, he will never dare to appear in court on his own volition in whatever capacities. Even in civil suits wherein he is the plaintiff, his lawyer will fight tooth and nail to get a summary judgement without the need for him to appear as a witness on technical grounds.

If he could make silly slips as regards the "sauh and layar" and the "29-15" calculation, the chances are he could also make fatal slips that may cost his case when grilled by the defense lawyer. From my observation, he is only good in reading prepared texts word by word, but his demeanor is left much to be desired.

  15. Looking at Apandi now and his attitude and how he dealth with legal issues that affects members of the opposition, members of the administration and critiques of the administration shows his real attitude & political inclination when he was a Federal Court Judge.

God saves Malaysia if other superior court Judges are cut in the same mould as Apandi. We are now not very sure if judgments given by Apandi are based on the merits of the case or based on his personal or political inclination. This fella should not be in the country's justice system. either as Judge or Prosecutor. He should just be a lawyer for Umno and Najib.

  16. Kadiag, salaam.

Aku tersentak juga bila hang ungkap perkataan 'country yokel'. Kumpulan ni lazimnya sangat konservatif, macam dlm lagu 'Okie from Muskogee'. Dlm nobel John Steinbeck, 'Grapes of Wrath' depa terpaksa berhijrah ramai ramai dari Oklahoma dan great plains kerana dihimpit kemiskinan angkara 'great depression' dan 'dust bowl' kerana kemarau panjang ke California, Washington dan Oregon. Rata rata depa rakyat marhaen yg kurang pendidikkan 'formal' jauh sekali berbanding orang Pendang yg mengaji sekolah tinggi2 di London in Scotland, New Zealand ka apa ka, dan punyai tasawur atau 'cognitive worldview' yg sangat berbeza. Munkin hang nak rendah diri kod, berbanding dgn orang macam Datuk anak Mansog, yg katanya kerja dgn ratu Menangkerbao tu.

Bukan nak kipaih hang Kadiag, tapi tulihsan hang kali kira 'kau' juga, terutama nampak hang bulih kekaikan kewarasan, mat saleh kata 'sanity' dlm ambien atau suasana tercabut ense laa ni. AlHamdulillah.

Lagi sorang (munkin hang tertinggai dlm senarai hang) yg sedang dok 'meningkat maju' dari kalangan yg 'percaya' atau 'believer' orang Pekan tu, ialah anak Musa, kenun2nya wakil Ketereh tu.
Maghap no kalau ada telanjog. Wa sallam.

To further add to my earlier comment (8:39 am), in the event he loses the case, it will cause a huge embarrassment to him. Over and above that, it will expose all the lies, intrigues, conspiracies and deceptions about 1MDB.

Will Najib dare to take the risk that may ultimately cost his premiership?

    Sallam Dato'

We elect members of Parliment so that they could do their job to make our life better.

Instead, they make statements like “you have to wake up early” to avoid traffic jam etc. We are already used to all these dumb and stupid statements.

Now, they are making a show about 1MDB debate. Opposition already come up with Rafizi, replacement for the debate. I doubt very much it is going to take place.

Rather than watching lousy show by actors with predictable plots and scripts, better to watch new James Bond movie (Daniel Craig acting).

  20. Salam Datuk AKJ.

Thanks Datuk A. Kadir Jasin. Take good care ;))

    Salam Datuk,

The Datuk Seri Mappadulung Daeng Mattimung Karaeng Sanrobone simply cannot speak off the cuff. He is nothing, unless in a controlled environment. It is also why huge amounts of taxpayer money have been wasted on PR consultants to polish the unpolishable.

That means he would wilt completely under cross-examination.

I can also understand the sheer cowardice of his lawyers in avoiding the US courts. To appear before an impartial judge with no "kabel" to exploit must be an intimidating (and novel) experience for an UMNO lawyer. The given reason, that their client wants money as damages, is ludicrous. 2.6 beliyon tu tak cukup ke?

It is UMNO that has bequeathed this "gift" and the accompanying tante (hadiah percuma) to the nation.

It is UMNO that must correct its mistake.

Every year that the Mappadulung Daeng Mattimung Karaeng Sanrobone stays in power is a year of Malaysia's future wasted.

  22. Arul Kandasamy, jangan memalukan company.

First, TDM was stopped by the police from continuing his speech at the abortive "Nothing to Hide" forum held at the very venue where he reigned supreme for 22 years.

A few days he again faced the police in pursuance of the latter's investigation. The only consolation he was not summoned to Bukit Aman or any District Police Hq to record his statement.
