Ada Kes: PAC Arah Siasat 1MDB

ADA kes terhadap 1Malaysia Development Berhad (1MDB). Itulah yang boleh disimpulkan daripada laporan Jawatankuasa Kira-Kira Wang Negara (PAC) yang diedarkan di Dewan Rakyat hari ini.

Ini terbukti apabila badan Parlimen itu meminta pihak agensi penguat kuasa menyiasat bekas Ketua Pegawai Eksekutifnya, (Datuk) Shahrol Azral Ibrahim Halmi.

Menurut laporan Bernama, PAC juga mahu siasatan dijalankan ke atas anggota pengurusan lain, termasuk Lembaga Pengarah atas “kelemahan-kelemahan pengurusan syarikat itu.”
 

Ia turut mencadangkan agar Lembaga Penasihat 1MDB dimansuhkan bersama artikel 117 di dalam memorandum dan artikel persatuan syarikat.
Lembaga Penasihat 1MDB dipengerusikan oleh Perdana Menteri, (Datuk Seri Mappadulung Daeng Mattimung Karaeng Sanrobone), Mohd Najib Abdul Razak.

PAC mendapati, terdapat kelemahan dan kekangan-kekangan dalam 1MDB dan pihak pengurusannya perlu mengambil tanggungjawab atas kelemahan itu.

Arahan PAC agar agensi penguat kuasa menyiasat 1MBD adalah penting kerana agensi penguat kuasa seperti Suruhanjaya Pencegah Rasuah Malaysia, Bank Negara, Polis Diraja Malaysia, Ketua Juruaudit Negara dan Pejabat Peguam Negara telah pun menjalankan penyiasatan, sama ada secara bersendirian atau berkumpulan, sebelum dibubarkan dan diarah berhenti pada pertengahan tahun lalu.

Malah Bank Negara telah dua kali mengemukakan perakuan agar 1MDB dituduh di mahkamah kerana melanggar peraturan pemindahan wang tetapi ditolak oleh Peguam Negara, (Tan Sri) Mohamed Apandi Ali atas alasan tidak ada kes.

Laporan PAC itu memutuskan yang “segala rujukan kepada YAB Perdana Menteri” perlu ditukar kepada Menteri Kewangan, selaras dengan peruntukan bahawa 1MDB adalah kepunyaan Menteri Kewangan Diperbadankan (KMD).

Selain Perdana Menteri, Mohd Najib juga memegang jawatan Menteri Kewangan.

Perkara 117 di bawah memorandum dan artikel persatuan 1MDB, antara lain menetapkan semua keputusan mengenai lantikan dan pemecatan pengurusan atasan 1MDB, serta sebarang komitmen kewangan, termasuk keputusan pelaburan 1MDB yang boleh mempunyai kesan kepada jaminan kerajaan Persekutuan perlulah mendapat kelulusan bertulis Perdana Menteri.

Dalam laporannya, PAC mendapati pengurusan 1MDB beberapa kali tidak mematuhi keputusan dan arahan Lembaga Pengarah atau pun bertindak sebelum mendapat kelulusan khusus daripada Lembaga Pengarah.

“Terdapat beberapa pelaburan dan pinjaman besar yang dibuat tanpa penilaian terperinci (termasuk penelitian impak terhadap aliran tunai syarikat) dan beberapa keputusan besar telah dibuat melalui resolusi bertulis,” menurut laporan itu.

PAC juga berpendapat, penggunaan hutang yang berlebihan dalam struktur modal tidak boleh dibenarkan sama sekali, lebih-lebih lagi apabila aliran tunai syarikat tidak mencukupi.

Ia juga menyarankan kawal selia yang lebih rapi oleh Lembaga Pengarah, termasuk mempersoalkan harga belian aset dan kos hutang.

Bagaimanapun, PAC mendapati kerajaan telah mengambil langkah serta-merta untuk memperbaiki masalah aliran tunai syarikat yang mula timbul pada November 2014.

Pengurusan tertinggi baharu 1MDB telah dibawa masuk selepas itu sebelum pelan rasionalisasi dibentangkan kepada Kabinet pada 29 Mei 2015.

Kesimpulan

Daripada laporan Bernama itu, kesimpulan yang boleh dibuat bahawa terdapat banyak kelemahan dan perlanggaran urus tadbir korporat melibatkan pengurusan, Lembaga Penasihat, Lembaga Pengarah dan badan kawal selia teratas, iaitu Kementerian Kewangan.

Daripada apa yang telah didedahkan secara rasmi oleh penyiasatan dalam dan luar negara atau yang diperkatakan dengan meluas, jelas kelemahan-kelemahan yang disebutkan oleh PAC itu mungkin mempunyai unsur-unsur kecuaian, pecah amanah dan corporate malfeasance .

Dengan arahan PAC itu, tidak ada alasan lagi bagi agensi penguat kuasa, khususnya SPRM, PDRM dan Bank Negara untuk tidak meneruskan siasatan ke atas 1MDB atau cuba mensabotajnya kecuali mereka sengaja mengingkari arahan Parlimen.

    They can investigate all they like but I believe no case will be brought to court if it can implicate najib. Not with najib and the pandi guy still in office.

    1. Drama baru.... dengan episod2 dan skrip2 sama untuk tahun2 akan datang... siasatan masih dijalankan dan tiada komen boleh dibuat sehingga siasatan selesai. Tunggu lah sedekad dua lagi...

    Arahan Majlis Raja-Raja depa boleh buat dak ajer, inikan pula PAC. Report polis Datuk Seri Khairuddin Abu Hassan pada 24 April 2015 dulu pun tahu kat mana hujung pangkalnya. Entah diambil tindakan atau tidak. Bila tanya IGP asyik bagi statement klise polis masih lagi menyiasat. Dah nak dekat setahun dah, takkan belum habis lagi siasatan. Dalam tempoh setahun tu update langsung tak ada dari pihak polis.
    Berapa banyak bukti dah dikumpul, sudah ada ke tangkapan, dah soal siasat saksi ke belum, the public is in the dark di tahap mana siasatan tu sekarang. Tiada inisiatif di pihak PDRM untuk memaklumkan kemajuan siasatan. Kena tunggu orang tanya baru nak jawab, tu pun jawapan standard je.

    Apa saja laporan yang keluar Najib akan tetap mengelakkan diri nya dari terpalit dengan menjadikan beberapa individu sebagai kambing hitam ,ok cukup pasal 1MDB entiti ini memang dah rosak yang penting wang RM2.6 Bliion akaun najib dan RM42 juta dari akaun SRC masuk akaun najib mesti dibawa kepengadilan ,bukan setakat jawapan tak tahu siapa yang masukkan wang tersebut pokok cerita mesti bertanjungjawab semua ini bukan hulurkan kambing hitam untuk dikorban kan ,sebelum ini dah ramai dikorban kan jangan yang ini pun nak buat mungkar dunia akhirat dan disokong oleh rakyat malaysia yang masih dunggu.

    The dedak squad are very quick to proclaim that Mappadulung Daeng Mattimung Karaeng Sanrobone is cleared.

    But no forensic audit has been done, and it is clearly established even by the PAC that numerous outflows of money are unaccounted for:

    "The Public Accounts Committee's (PAC) probe into 1MDB found that the sovereign wealth fund had paid RM4.24 billion (about US$1.367 billion) to Aabar Investments PJS Ltd (Aabar Ltd) as security deposits in 2012, without approval of 1MDB's board of directors.

    The PAC, however, said 1MDB had not proven that Aabar Ltd is actually linked to Abu Dhabi firm Aabar Investment PJS, or the International Petroleum Investmnet Corp (IPIC)."

    The WSJ is not shifting. Today it reports:

    "The Wall Street Journal, citing Malaysian and global investigations, has reported how investigators have found over $1 billion was transferred to Mr. Najib’s personal bank accounts, the majority originating from 1MDB and moving via a web of intermediary entities."

    In fact, the PAC's findings are even more serious than the WSJ:

    "The committee’s report found the 1MDB fund had made billions of dollars in unexplained payments, including $3.5 billion in transfers to a company called “Aabar Investments PJS Ltd.,” according to a copy of the report submitted to parliament on Thursday."

    "The imitation Aabar, registered in the British Virgin Islands, was set up by Abu Dhabi executives involved in the running of the genuine firm, according to investigators in two foreign countries.

    The Journal reported last year that 1MDB had transferred $2.4 billion to the imitation company, but the parliament committee’s report put this figure at $3.5 billion."

    So how is Mappadulung going to slow down the pace of that investigation?

    There are 2 ways:

    a) Get Aabar and IPIC to issue a statement that all monies are accounted for

    b) Send one of the many dedak lawyers to sue the WSJ. That was supposed to have happened in July 2015.

    But Aabar’s No 2 man has been arrested and is heading for deportation to the USA.

    Apa punya perangai terdesak daripada seorang Perdana Menteri ?

    Langsung dia cuba mengaburi kita semua yang tidak mampu diKABURI lagi bahawa dia sebagai KETUA PENASIHAT UTAMA 1MDB langsung tidak bersalah, tidak ada silap.

    Reported in Reuters that the entire 1MDB board offered to resign following the tabling in parliament of the PAC inquiry into the fund. Of course everyone better leave the sinking ship or get caught up in lawsuits for negligence, criminal or otherwise in their duties. More and more revelations coming. Good ah!
    Their head CEO Arool already said his job was done.
    What exactly has he done, done what?
    What about the Finance Minister who directly oversees 1MDB, job done and has he tabled his resignation too? If go, everyone must go lah, leave a clean slate.

    And we can expect Zeti to make a firm statement as a parting shot before she leaves office.
    Tulah hidup ni mesti sabar. Tak perlu melatah ke hulu hilir jaja kebenaran konon macam Suami Ummi Aida tu. Nah, go on from here and not based on unverified reports.
    But I read Salleh Keruak still maintaining the Big Boss is not implicated. Absolved like AG declared.

Senang jer sis, kalau ada orang ragut kita, kalau kita ada kemampuan kita akan kejar peragut tu kan?, supaya kita boleh dapat balik barang kita and supaya peragut tu tak menjadikan lebih banyak orang sebagai mangsa lebih2 lagi yang tak berupaya. Or sis rasa kita just perlu sabar, tarik nafas and pelan2 call polis biar polis selesaikan?
      Perumpamaan ni lebih kurang sama lah dengan situasi sekarang, lebih lama kita tunggu lebih banyak kerugian pada negara, sebab tu lah TunM bertindak, sebab beliau tergolong dalam kalangan orang yang mampu. Sit, watch and wait bila nampak jenayah dan kesalahan dilakukan depan mata kita ialah perbuatan orang2 yang lemah, malas dan penakut.

    Secara rasminya PAC menyatakan Ahli Lembaga Pengarah 1MDB melanggar tataurus syarikat. Ahli Lembaga Pengarah 1MDB juga menjadi Ahli Lembaga Pengarah beberapa GLC seperti Tabung Haji dan LTAT. Perletakan jawatan Ahli Lembaga Pengarah tidak harus terhenti di 1MDB sahaja, mereka sepatutnya meletak jawatan sebagai Ahli Lembaga Pengarah di GLC yang lain.

    I have good news, Datuk Shahrol.

    You are not going to be a scapegoat or kambing hitam, but what we might call a "kambing sandiwara".

    Just like another famous livestock case involving cows and condos, all it takes is one letter from defence counsel to the A-G, and the charges (if any, we don't know yet) will be mysteriously dropped.

    So don't worry.

    However, there are a lot of money flows that are completely out of Malaysia's cover-up ability.

    In most of these countries, one letter from defence counsel to the A-G will do nothing.

    Justice finds its own way eventually.

    Terima kasih atas laporan Datuk tentang laporan PAC terhadap 1MDB dan mungkin memakan masa sikit untuk membaca 110 mukasurat sebab bukan semua orang bolih faham dan bolih baca dalam Bahasa Malaysia.

    KITA JANGAN LUPA bahawa Rakyat Malaysia ketika ini menghadapi TIGA masaalah besar.

    1. 1MDB. Laporan PAC 7hb April 2016. Secara kasar, penguatkuasa seperti BNM, PDRM, MACC bolih membuat tindakan susulan. Aku rasa ini tidak akan terjadi sebab bos mereka ada lah Perdana Menteri. Tapi kita baca dulu lah sebagai rakyat biasa.

    2. RM2.6 Billion "derma Arab" dalam akaun peribadi PM Mohd Najib yang dia sendiri mengaku duit sebanyak itu....yang kemudian, konon nya (si Apandi yang cakap) sudah di "kembalikan sebanyak RM2 billion" kepada "penderma Arab" tersebut. MENERIMA DUIT INI SALAH...INI BUKAN DUIT PERIBADI...TETAPI UNTUK RAKYAT MALAYSIA SEBAB DIA MENERIMANYA ATAS NAMA SEBAGAI "PERDANA MENTERI MALAYSIA". DUIT INI SEPATUTNYA DI"LAPORKAN" PADA RAKYAT...MASUK DALAM TABUNG UNTUK RAKYAT.

    KALAU MOHD NAJIB BUKAN PERDANA MENTERI MALAYSIA....DIA BOLIH MAKAN DAN MINUM DUIT RM2.6 BILLION YANG SEMACAM INI IKUT SUKA HATI NYA. ITU HAK DIA. AKU TIDAK MAU TAU. ADA BANYAK LAGI BILLIONAIRE DI MALAYSIA INI.

    3. RM42 Juta dari SRC International masuk akaun peribadi PM Mohd Najib. Katanya dia tidak tahu padahal syarikat itu 100% kepunyaan Kementarian Kewangan, dimana dia lah Menteri Kewangan. Jangan pura pura bodoh.

    Hanya Datuk saja sebagai wartawan yang bolih mengingatkan kami semua pada tiga perkara diatas. Terima kasih Datuk.

    PAC arah siasat 1MDB.

    Persoalannya "Siapa" yang kena buat siasatan?...

    1. PDRM...Orang buat laporan polis tentang 1MDB pulak kena siasat!...bukan 1MDB...kata tunggu laporan Audit Negara...bila?

    2. SPRM...laporan bagi kat AG...AG kata takde kes....tapi ada bukti dia tunjuk ditangan yang dapat dijadikan kes!...

    3. BNM...AG juga tolak kes...

    Parlimen boleh keluarkan arahan...tapi dari segi pentadbiran, Parlimen tak boleh beri arahan terus kepada agensi kerajaan. Setiap agensi masih dibawah kementerian yang di kuasai oleh Menteri.(Menteri semua belaan Najib)

    Pi mai pi mai tang tu jugak!...

    AG sepatutnya sebuah institusi yang telus dan penuh integriti...malangnya institusi tersebut dicemar oleh seorang manusia yang tiada maruah....

    Apa jua siasatan yang dibuat oleh pihak yang berkuasa (PDRM,SPRM,BNM, Auditor General) akan disekat oleh manusia yang bergelar AG ni!....Mana lagi jalan untuk menuju kebenaran?...

    Mahkamah sahaja satu-satu institusi yang dapat menyelesaikan kemelut ini dengan adil...Semua pihak yang terlibat dapat mengemukakan hujah dan bukti masing-masing. Rakyat juga dapat mengikuti perjalanan perbicaraan dan media membuat laporan untuk tatapan semua.



    Najib...walau apa pun rujukan yang dipakainya...Menteri Kewangan ke... Perdana Menteri ke... Penasihat Esekutif ke... Presiden UMNO ke...itu semua jawatan dan tanggung jawab...Macam kata MAT Maslan...Najib memang pandai sebab buat bermacam kerja dalam satu masa....Ape kejadahnya?....Jawatan tu kan semua Najib yang sandang...begitu juga tanggung jawab yang mesti digalas!...Kenapa pulak tak boleh sebut direct nama dia?...Ape?...nama Najib keramatke?...kalau dalam mahkamah pun tak leh sebut nama...dah tu kalau kena jel Menteri Kewangan yang kena jel?....

    Susah nak cakap Datuk...orang Sarawak kata "Pecah palak mikir! Paloi!...Tuyuk!"

    Mengikut apa yang tersiar di tv RM 42 bilion tu tak hilang saparti didakwa TDM.
    Kalau tak hilang kenapa harus jual aset untuk bayar hutang. Sekarang aset hilang dan duit pon lesap bayar hutang.

  19. Datuk, not only are Malaysians but the world is also getting fed up with the impunity and arrogance of the defenders of 1MDB. This does not bode well for Najib. There is no way out for him. I would suggest he allow our courts to judge him before other, more powerful forces that may exist in world politics and economies take matters into their own hands to put an end to the embarrassing episode. It was a mistake to bring international banks such as Rothschild into the picture. Such institutions will not stand idle and do nothing while they are being exposed and shamed.

  20. IPIC cannot simply make the statement that the money has indeed been received nor alter its financial statements, as it is a London FTSE listed company. London FTSE is renowned for being very strict about any listed company's reported financial statements. IPIC's previous financial statements has never shown the payment at all. Aabar Ltd is obviously a dubious shell company which was wound up after receiving the payment. The key player here is Mohamed Al Husseiny, who has been arrested in the UAE and is waiting to be extradited to US. All we can do now is wait until he sings in front of the US Grand Juries.

    Hope no one has missed the obvious although the PAC report did not bring up the PM's name. Every transaction carried out by 1MDB and its management had to be approved by the PM/Finance Minister. So, he remains culpable to the very end.
    Shahrol is the scapegoat, the sacrifice.

    From today:

    "The Swiss Financial Market Supervisory Authority (Finma), which is responsible for Switzerland's financial regulation, has described the Malaysia's 1MDB and Brazil Petrobras scandals as "clear cases of corruption. Finma chief executive officer Mark Branson was referring to money from the two entities which passed through the Swiss financial system."

    The dedak eaters will claim that the PAC has "cleared" Mappadulung of wrongdoing.

    There are a few points to note:

    a) About 80% of the most damaging transactions involving 1MDB took place OUTSIDE Malaysian jurisdiction. They involved Swiss, Singapore, UK, HK and UAE banks and the movement of money across offshore accounts.

    b) The MACC and PAC both were denied any access to the records of these transactions. (The MACC requested under MLA rules but the 24-hour replacement refused.)

    c) The main dedak ministers are claiming it is "proved" that Mappadulung's 4 billion into personal accounts did NOT come from 1MDB. However, the PAC report cannot prove this one way or another, because it was not part of the PAC's remit to forensically examine the connection between the AmBank riches and 1MDB.

    d) However, several other countries are pursuing this with vigour.

    e) Hence, please remember the names of all the dedak ministers who claimed it is "proved" that Mappadulung's 4 billion into personal accounts did NOT come from 1MDB. Their names will be come in handy when they are proved wrong, as may well happen in the next few months.

    Buat jamil, maksud hilang Dr M, duit tu dah hilang/takan dpt blk/entah kemana. Maksud tak hilang si bangang-bangang tmasuk laki mah sendiri, (najib pakai kat tv, maka fair game) ialah duit tu semua accountable temasuklah bila duit tu pegi masuk akaun syarikat yg nama dekat2 serupa. Jadi duit tu tak hilang cuma salah masuk akaun.

    Semantic. Dari dulu lg asek dok main game sama. Skang ni bukan main lagi cik salahuddin kita a.k.a another brick in the wall manggil Dr M "the old man".

    Dasyat skang suma sebab cash is king.

    There is no need whatsoever for the Auditor-General's Report on 1MDB to be classified under the OSA.

    In fact, it is quite silly and puts the govt in a bad light.

    There is no way that the PAC report can be debated in Parliament or anywhere else unless people have seen the documents it is based on.

    Datuk, firstly, Shahrol must step down from his current positions until 1MDB investigations into his role is completed. He cannot claim he's no longer with 1MDB, that absolves him from further "negligence" in his new posts.
    Secondly, Najib must do likewise from his position as Finance Minister and Prime Minister. Shahrol has claimed in his meetings with PAC that the PM/FM ignored the board's recommendations for further diligence checks, thus Najib did play the most pivotal role in 1MDB.
    Thirdly, PAC must lodge police reports to charge Shahrol and Najib accordingly.

    So as widely speculated, 1MDB has done a fire sale of its assets and essentially wound itself up. Gerai dah tutup dah.

    What was the point?

    What did the rakyat get in return for guaranteeing a large part of an RM50 billion debt and investigations in 8 countries?

    Were hundreds of thousands of jobs created? No. Malaysians trained? No. International competitiveness enhanced? No. (Unless you count scandals, of course, because 1MDB is by far the most scandalous national wealth fund on earth.)

    In the end China acquires national assets for a discount price. Prime land was sold dirt cheap and revalued and revalued and revalued. Old power plants were overpriced and sold in suspicious circumstances.

    Multiple lies were told to the public, some in Parliament.

    If the MOF is the 100% owner, why hasn't the Minister of Finance resigned?

    The same reason that Shabery Cheek and KJ don't care that RM100 million was stolen from KBS under their watch.

    Malaysia does not practice ministerial responsibility, and we are very pro-corruption, as befits a highly corrupt 3rd world country with (currently) the world's most famous Prime Minister.

    Aabar, Blackstone, Tanore, Falcon, AmBank. The dots are being connected now.

    No-one transfers that kind of money, of billions of ringgit, unless there is a pre-arranged plan to receive the money. Billions of ringgit do not simply move by accident.

    And no-one charges large sums of money to an SRC credit card, unless they are fully aware that there is plenty of money in that account.

    This is all basic common sense.

    As they said, the paper has been vetted before it was tabled to the parliment. Anything refers to Najib has been deleted.

    Of course there will be Dato Sharol name appear as he is the proxy and signatories for all the actions being taken by 1MDB. Given his background as consultant in international consutling company, he should be very knowledgeable about all the principles of management and finance when it comes to running a company, much so for RM42 billion worth of company. So all this hanky panky wheeling and dealing is unlike him given his extensive background and he will ended up taking the fall for Najib as well as subjected for further inquiries.

    He would be compensated a good sum of money for takinng the fall for Najib and we will expecte that further investigations on him will eventually lead to the conclusion that the company is not managed well and certain procedures was not being follow. So the penalties that would befall on him is merely he would be simply be reprimanded and for him to take lessons from all his wrongdoings.

    At the end, everyone got scot free and life goes on.

    My take...Rakyat simply sick of all these shenanigans and never ending drama. Enough said.. the PM is simply hiding behind this cloak of masquerade... and for rakyat sooner or later they hope that the international investigation would come up with conclusive evidence that will prove without any doubt there are billions of dollars actually went into the PM private account. Then will see how the PM office try to squirm through and answer to all these actions...Until then we will keep watching all these daily drama keep on playing out...

    The BOD of 1MDB takes instruction from the Chairman who is also the PM of Malaysia even though it is not in writing. The most powerful figure in Msia.

    The same goes with the CEO.

    Both the BOD and CEO are highly educated and experienced personnels yet they are Dumb Asses. They should know that they can be accountable in the instruxtions given are not in writing.

    A stage has been arrived at, where there is no longer room for denial for Najib.

    He can no longer say that nothing went wrong and that his critics are criminals rather than the men at 1MDB. And he was the man responsible: the sole decision-maker, the sole signatory, the PM and the FM, the man at the top.

    The reason lies with key developments in the past few days:

    – First, Malaysia’s own Parliament has now judged the criticisms of 1MDB to have been correct and justified and Najib’s months of denials to have been untrue

    – Second, the international press has finally established a money trail for over US$100 million from 1MDB, to a fake off-shore company named Aabar Investment PJS Limited and then straight into Najib’s step-son’s Hollywood production company, Red Granite Pictures.  Just three short steps and Najib has failed to sue against the allegations.

    – Third, a breath-takingly frank statement by the head of FINMA, the Swiss financial regulator yesterday proved that the global community has also concluded that 1MDB is a criminal enterprise.

    With the world shaken by the money laundering scandal exposed by the so-called Panama Papers, it was 1MDB that this senior Swiss enforcer chose as his example of massive crime in this field.

    Faced with such a trio of damning developments in the past few days, Najib should of course accept responsibility and go.

    " Najib is the Finance Minister whose ministry wholly owns 1MDB, which is his brainchild in the first place.
    He is also the person whose personal written approval is mandatory to every investment and major transaction done by 1MDB under the M & A of the company, besides being the chairman of the advisory board.

    So, Mr. Tan Seng Giaw, how is it that Najib has nothing to do with the heinous financial fiasco of 1MDB which has shaken and scandalised the country beyond imagination? How is it that, according to you, the management is solely responsible for the entire disaster?
    Common sense tells us that these executives on the ground could not have mastered enough power and authority to rob the national wealth fund of so many tens of billions of ringgit. They couldn’t have done it without being detected and without being punished for so many years.

    Laporan tersebut diolah supaya menjurus kepada BOD dan kambing hitam Sharol. Peranan Lembaga Penasihat tidak disentuh langsung...

    1. Lembaga Penasihat telah "override" keputusan BOD...contoh
    "Pengarah 1MDB pada 7 November 2009, Encik Shahrol Azral
    memaklumkan penilaian kedua tidak perlu dibuat terhadap aset
    syarikat usaha sama tersebut kerana Pengerusi Lembaga Penasihat
    tidak bersetuju dengan cadangan ini, tetapi mengarahkan Lembaga
    Pengarah 1MDB melantik sebuah syarikat perundingan bagi menilai

    As far as the PAC scope on this investigation is concerned, I believe and agreed that Shahrol Halmi is the person to be blamed. He should take full responsibility;

    1. Shahrol Halmi is the one who confirmed all the payments to be made via email to the bank although he knew that the payees were not party to the JV Agreement.

    2. He cannot assume that instructions from whoever via phone calls as evidence that he is not guilty,

    3. Shahrol Halmi has failed to advised his "boss" that the payee was not party to the JV agreement,

    4. Should he was pressured to proceed the payment from his "boss", although he knew the payee was not party to the JV Agreement, he should have resigned honorably. Good example were shown by Tan Sri Bakee and Tan Sri Azlan Zainol.

    5. Unless Shahrol Halmi have "papers" approval and instruction from his "boss", then only he can claim that he is innocent.

    6. The act to proceed payments to wrong payees is a criminal offence. He should be put behind bars.

His direct involvements with 1MDB simply remains camouflaged by 1MDB's unethical refusal to produce its full complements of banking accounts for examination.     The 24-hour replacement just needs to wait 2-3 months, get the report, then say "insufficient evidence".

    2. I could not remember receiving any comment from Pompuan on that subject. As far as I could recall, I published every single one of her comments since she joined our blog.

    3. If, by any chance I have overlooked her comment on Guan Eng or any subject, I say sorry and implore her to resend so that I can publish.

    4. I deliberately did not comment on Guan Eng's house because I don't want to deviate from this mammoth called 1MDB and this leader called Mohd Najib.

    5. Guan Eng's house is a "kuman" compared to Mohd Najib's "gajah" called 1MDB.

    6. In any case the investigations on Guan Eng's had just begun but the PAC damning report on 1MDB had been issued.

    7. Furthermone, Guan Eng is only the CM of one state but Mohd Najib is the PM of a once great country that he had singlehandedly turned into the laughing stock of the world.

    Najib has reached a point of no return after all the lies, manipulations, deceptions, cajoles and threats, directly or indirectly, by him and his henchmen. More so, he now believes he has the staunch support of UMNO/BN.

    Although there are good and ample information and leads in the PAC Report for a follow-up investigation,I am rather sceptical whether there will be a directive for such line of action by the authorities concerned.

    Najib cannot afford to take the risk as had happened in the earlier Task Force imbroglio.

    1. It gives me an impression that there is an MOF as one entity, on one hand and there is this person, the Finance Minster on the other.

    2. So, this is the case of "the left hand does not know what the right hand is doing" cropping up again...and again...and again...quite a very peculiar behaviour of this person called PM Mohd Najib, if I may add, so to speak.

    3. This "peculiar behaviour" was again reported by the PAC. This "peculiar behaviour" is in sharp contrast to his counterparts, especially those from Great Britain, Canada and other European countries.

    4. My greatest admiration to The Most Honourable Prime Minister, Mr.David Cameron who not only publish his current and past INCOME TAX RETURNS, but have it debated live on Skynews and local medias. Only now we know, the behaviours of these "kafirs" are way above and superior to that of our "Syariah-compliant Islamic Index"ed-office of our Malaysian Prime Minister.

    5.     I would like to see Shahrol explain how he deliberately, of his own accord, diverted US$700 million into GoodStar when he clearly had no relationship with Jho Low. But there is no denying that Mappadulung Daeng Mattimung Karaeng Sanrobone did have such a relationship; that photo does not lie.

    Razak Baginda is living in exile very comfortably, and recently claimed there was "nothing unusual" at all about the Mongolian lady's murder, as "people die in police custody all the time".

    Will Shahrol also be living in exile in 2-3 years time, telling people there was "nothing unusual" at all about the cashflows in 1MDB?

    Sadly (fortunately?) I think the real truth about 1MDB will be exposed long before Shahrol gets his promised acquittal or "NFA" on his case.

    The crux of the matter, Is there criminal elements exist,be it,fraud,misrepresentation,or duty of care imposed on the whole corporate structure of 1MDB.
    Yes certainly the CEO will not has umlimited authority to act on his own without proper approval and complete documents involved and duly signed.
    Can oral agreement or instruction be subtantiated by any followup documents.The CEO happened to be cambridge graduate,certainly he knows that the director of the compamy is the alter ego of the company and in event of failing to perform fidisury duties stern action will be taken against them
    Looking at the composition of board directors, they are well known seasoned corporate figures.
    Just wonder why 3 management team has escaped the police radar screen, nik arif to mention a name.
    I hope the CEO must tell all inorder justice to be served, otherwise you will be like those two policemen in the famous case.To begin with you have no interest with the victim,

    YBhg Dato dan Pembahas yang saya hormati. Blog Dato telah dengan nyata membolehkan kita mengetahui kedudukan kita selepas 50 tahun Merdeka. Ini adalah melalui kesanggupan Dato untuk menyiarkan sebarang pendapat mengenai isu semasa dengan syarat ianya tidak menyalahi undang-undang.

    Dalam isu semasa telah didedahkan oleh seorang blogger ada satu kumpulan yang mempunyai strategy mengendali isu ini tetapi terdapat masalah pembocuran maklumat dimana pihak lawan dapat mengambil tidakan satu langkah terkehadapan.

    Memang nyata sekarang mengapa isu ini perlu diselesaikan dalam satu jangka masa yang cepat kerana jika tidak ianya akan menjadi melarat yang kita tidak tahu apa kesudahannya kerana pelbagai isu baru akan timbul menyebabkan persepsi rakyat akan berubah .Sebabagai contoh ada pemimpin yang mengubah kedudukan dalam isu ini yang menjadi keadaan agak kucar -kacir.

    Perkara yang ada sekarang bukannya perkara main-main dan perlu dirancang dengan baik supaya ianya tidak memudaratkan mana-mana pihak. Sebagai contoh walaupun tidak banyak perkara baru yang boleh dikaitkan dengan kes ini adalah tidak wajar mengeluarkan kenyataan yang tidak bijak seperti tiada pilihan untuk menyelesaikan isu selain dari meminta Negara luar untuk campur tangan dalam hal-ehwal Negara kita kerana ini membolehkan orang bertanya mengenai ketaatan kita kepada Negara yang kita minta rakyat menyelamatkannya dari kerosakan.Kita perlu berhati-hati mengeluarkan kenyataan supaya ianya tidak digunakan untuk mempersoal kewibawaan kita.

    But what can be discussed then?

    The AG (TS Ambrin) has written a report that is now top secret.

    Why?

    This country's administration, once admired, has become a joke.

    Everything is done purely to keep Mappadulung in power so that others can profit from his weak, spineless nature.

    TS Ambrin himself should demand disclosure of his report.

    I strongly believe that TDM views the 1MDB scandal has escalated into a situation that is jeorpadising national interest. And the man responsible for it is Najib and those aligned to him particularly those from within UMNO/BN.

    His target is therefore Najib, NOT UMNO. Making Najib resign is therefore his priority so that UMNO can regain its strength to confidently face the 14th GE and the country returns to normalcy.

    Towards that end, at the outset he tried his best to rally the support of UMNO, but all along it has been futile for reasons you are fully aware of.

    Being the man who has built the country during his 22-year premiership, what choice does he have when he sees the situation continues to deteriorate ? He has to align himself with all the available resources within the country including the opposition primarily with a view to preserving national interest. In no uncertain terms he is a traitor to UMNO and the Malays as alleged by pro-Najib elements nor he is conniving with the opposition.

    The latest, he is strongly condemned for soliciting foreign support to further his cause to topple Najib and that he has reneged on his principle with regard to foreign intervention in this country. On this, he has qualified himself by stating that all shall be done within the confine of the laws. And he is full conscious, though his enemies. may level him as senile, that the country's independence will continue to prevail and that it will not be subjugated to foreign power.

  67. Kalau betul Najib dan Isteri amat mengambil berat tntang peniaga bumiputera, alangkah baiknya jika beliau 'bershopping-sakan' di Medan Mara. Disitu juga terletak MARA Digital. Banyak terdapat kedai Kain, Minyak Wangi. Tapi outlet jenama Chanel, tak ada.

    Dengan jumlah beratus-juta ringgit, shopping diluar Negara, sudah tentu ia akan merugikan pengaliran WANG keluar Negara. Kalau shopping di Medan MARA, bayangkan berapa ramai peniaga bumiputera akan beroleh 'durian-runtuh' dari beratus-juta itu.

    It seems that "Shahrol" is resisting the temptation to become "Sirul". It would be very interesting to discover whether Mappadulung actually did sign these documents. If so, then although he has skin thicker than a badak air, he cannot blame others. Personally I do not believe that the whole Good Star scam could have been Shahrol's idea. That makes no sense whatsoever.

    Tun is now being misquoted by the dedak squad. He is merely saying that any overseas investigations must proceed without fear or favour.

    Even Obama cannot sabotage the FBI and DOJ.

    The mat salleh are better in that respect; they would certainly have made much noise over Mappadulung's sabotage of the AGC, BNM, PAC and SB since July 2015.

    Malaysians seem not to care, but then Mappadulung has lost more than 30 points of Malay support since 2014.

    He may call a snap general election to ride the Adenan crest. And Hadi will need to decide whether he wants to remain pro-rasuah.

    Let us see if he still has time left.

    Maka atas sebab itulah, ada kebarangkalian besar, Guan Eng akan berjaya elak dari didakwa. Jika kes 'banglo' dibawa ke Mahkamah, sudah tentu isu 1MDB, RM 2.b Billion/RM 2 juta dalam akaun peribadi Najib/Rosmah akan dibangkitkan lagi, kali ini dalam Mahkamah pula. Maklumlah, DAP punyai ramai Peguam sebagai Ahli Politik.

    Dalam scenario ini, sudah tentu, Penyokong UMNO-Najib dan blogger Pemakan-dedak akan 'terkilan'. Ramai dari mereka memihak kepada Khir Toyo dan beliau dianggap sebagai 'kambing-hitam' kerana ketika itu, BN mahu membuktikan kepada Rakyat bahawa Kerajaan tidak pilih-bulu dalam membenteras RASUAH. Oleh yang demikian, ternampak seolah-olah UMNO hanya 'berani' bertindak terhadap bangsa sendiri saja.

    Dr.M mempergunakan Kit Siang & son untuk menjatuhkan Najib saja, bukan Parti UMNO....tak boleh kah?

    Tapi.....pemakan-dedak dan TV3 guna MP DAP (Tan Seng Giaw) untuk mempertahankan Najib, boleh pula.

    Dr.M tidak menjemput campur-tangan asing. Beliau hanya mempersoalkan, mengapa Australia tidak menyiasat, bank di Negara mereka, apabila terdapat transaksi yang mencurigakan. Itu pun sebagai 'last resort' untuk menurunkan Najib.

    Najib lebih jelas 'menyemput' campur-tangan asing dalam urusan Negara apabila 'menerima' derma dari Arab Saudi. Kerajaan beRaja Saudi amat anti-Syiah. Adakah Malaysia juga terpaksa terikut sikap mereka, anti-Syiah dan Iran?
    Adakah disebabkan 'derma' itu, kita terpaksa menyokong Arab Saudi dalam 'Pakatan Negara-Negara Islam Menentang Pengganas? (Harus diingat, bagi Kerajaan beRaja Saudi, Syiah adalah juga pengganas dan mereka bersama US, diketahui 'membantu' IS untuk menjatuhkan Hafez Assad, Syria. Istilah 'Pengganas' atau Terrorist, berbeza sesabuah Negara).

    Adakah disebabkan 'derma' itu, ATM menghantar anggota mereka untuk latihan-tentera, Northern Thunder di Utara Arab Saudi? Sudahkah mereka pulang ke Tanahir? Nampak seolah-olah, penglibatan ATM ini, cuba di'rahsia'kan dari pengetahuan Rakyat. (Sama seperti Najib pergi bercuti bersama keluarga, keluar Negara setiap hujung tahun, juga secara senyap-senyap?)

    Masaalah lebih besar, jika US, Singapura dan lain-lain Negara yang menyiasat pengubahan WANG haram 1MDB, menggunakan kes itu sebagai 'senjata' untuk mengugut/memeras PM kita supaya menuruti kehendak/telunjuk, demi kepentingan Negara-asing. Maklumlah, ada 'akaun-bank' yang dibekukan di Singapura.

    Adakah atas sebab itu juga, kita 'terpaksa' meminda 26 akta untuk memberi-laluan kepada TPPA? (Rakyat pun masih belum diberitahu dengan jelas, apakah akta-akta yang bakal dipinda itu).

    "Kalau jealouspun biarlah bertempat. Jangan pakai rembat je. Malu company."

    Seorang patriotic seperti saya akan merasa bangga jika melihat lebih ramai bangsa sendiri berjaya dan kaya-raya. Tiada langsung sifat iri-hati (jealous) atau PHD (Perasaan Hasad Dengi) dalam diri saya apabila berita Rosmah 'ketagih' shopping tersebar sejak dahulu lagi. Saya maklum benar akan sikap 'biar papa asal bergaya' masyarakat yang mementingkan "class", terutamanya dipihak kaum-hawa.
    Tetapi bila seorang Pemimpin tertinggi membelanjakan sejumlah WANG, berpuloh-kali melebihi gaji-tahunan, sudah tentu ia akan 'membuka-mata' Rakyat, bukan saja di tanahair, malah seluruh dunia. Berita 'Mega-shopping' ini pula tersebar ketika 1MDB berhutang berpuloh Beliyon dan urusan kewangannya dicurigai, dalam dan luar Negara.

    Harus diingat, MAP (Media Arus Perdana) seolah-olah 'malu-malu kucing' menyiarkan berita Mega-shopping Rosmah dan Najib. Mengapa ya?
    Setiap kali saya tanya di FB, samada ia benar atau tidak, penyokong Najib akan menjawap dengan menyiarkan gambar kereta mewah Dr.M dan anak-anak beliau. Pelik....saya tanya lain, lain yang dijawab. Azmi Arshad, sudah lama block saya di FB. Begitu juga Din Merican.
