Bernama melaporkan bahawa Yang di-Pertuan Agong Sultan Muhammad V telah
memperkenankan pelantikan Tommy Thomas sebagai Peguam Negara.
Datuk Pengelola Bijaya Diraja Istana Negara Datuk Wan Ahmad Dahlan Abdul Aziz berkata atas nasihat Perdana Menteri Tun Dr Mahathir Mohamad, Seri Paduka telah menitahkan perkara itu mengikut Perkara 145 (1) Perlembagaan Persekutuan.
"Kebawah Duli Yang Maha Mulia Seri Paduka Baginda Yang di-Pertuan Agong XV menyeru semua rakyat Malaysia untuk menerima bahawa pelantikan Peguam Negara Malaysia tidak patut menimbulkan konflik ke atas kaum atau agama, kerana semua rakyat Malaysia harus dilayan dengan adil tanpa mengira bangsa dan agama, " katanya.

Majlis Raja-Raja di bawah Perkara 153 Perlembagaan Persekutuan, Kebawah Duli
Yang Maha Mulia Seri Paduka Baginda Tuanku juga memperkenan penamatan
perkhidmatan Tan Sri Mohamad Apandi Ali sebagai Peguam Negara oleh kerajaan Malaysia.

THE New Straits Times reported in its online edition today that the de facto leader of the PKR, Datuk Seri Anwar Ibrahim, had been seeking audiences with the Malay rulers to assure them that the new government respects the royal institution.

It reported that Anwar had wanted to assure the rulers that Pakatan Harapan (PH) is not being controlled by the Chinese-majority DAP as claimed by Umno and Barisan Nasional in the run-up to last month’s general election.
Two very loaded and naughty statements – “Anwar assuring the rulers” and “PH not being controlled by the Chinese-majority DAP”.
It reported Anwar saying: “I told them not to worry because the government was not under DAP, and there were no attempts to eliminate the power of the rulers.”
What was even more sinister was the fact that the NST sourced this report from the newly re-launched The Malaysian Insight (TMI) news portal.
According to the NST report (quoting the TMI), Anwar said so in a speech to members of the Malaysian Muslim Youth Association (Abim) at their headquarters in Kajang on Saturday night.
Another proof of the NST’s sinister motive – reporting news that happened almost two days earlier and quoting a news portal.
But it is also possible that the NST has become so unprofessional and inefficient that it is two days late in reporting news or had missed the event altogether.
The NST
I stopped reading the NST several years ago so I don’t know much about the promptness and quality of its reporting. Only after the inauguration of the new PH government that its reporters were supposedly told that they are free to report what they see fit.
The PH victory has done some good to the NST journalism.
But I don’t give much credence to the freeing of its editorial stance because at the helm are the same editors who turned the paper into the Völkischer Beobachter of Umno.
The Völkischer Beobachter (The Racial Observer) was the mouthpiece of the National Socialist German Workers' Party or the Nazi Party.
The NST quoted TMI quoting Anwar saying: “The constitutional monarch will not lose power. I explained all this to them. My intention when I met them was clear, that is, to help explain the PH government’s policies to the rulers.”
According to report quoted by the NST, Anwar’s royal audiences – with the Agong, the Agong’s mama and several Sultans - had prompted rumours that he was undermining the Prime Minister, Tun Dr Mahathir Mohamad, by forging a pact with the rulers.
The Rulers, according to the report-upon-report, have a testy relationship with the PM.
If the report is worth anything, my take on it is this:
While Dr Mahathir runs the country as the Prime Minister, Anwar appears to be acting or behaving like a political commissar.
In the communist system, a political commissar is many
times more powerful than a battalion of soldiers.
The Rulers
I wouldn’t dare say that the Rulers are so insecure these
days about their position that they need to be assured and comforted.
On the contrary I think the Rulers are as confident and
assured as ever before. Why shouldn’t they? They are guaranteed by the
Constitution, lavishly provided for, wealthy and even Anwar kissed their hands!

For 16 months to April this year, a total of RM256.9
million had been allocated to the Yang di-Pertuan Agong for purposes of
accommodation, residence and palace, personal items, aircraft and
transportation, training and escort equipment, clothing and ceremonial items, gifts
and souvenirs, overseas visits and salaries of palace staff.
Of course like everybody and everything else in this
country including the Bangladeshis, the mainland Chinese, the Thais and the Wak
Jawa, they have to respect the Constitution for it is supreme. Nobody, not
even the dewa dari kayangan, is above the law!
It is this supreme law that gives soul and form to
the royal institution. It is this supreme law that gives birth to the Supreme
King – the Duli Yang Maha Mulia Seri Paduka Baginda Yang di-Pertuan Agong.
In
the legal parlance, the Agong and all of us are the creatures of the
constitution.
The Constitution that guarantees the right of the homeless
pauper who languishes in the back lane of Chow Kit also guarantees the right of
the King who lives in the gleaming RM650-million Istana Negara.
But unlike the pauper who evokes God’s name to earn
sympathy of the passers-by, the Agong evokes God’s name in his oath of office.
“In the Name of God, Most Gracious and Most
Merciful:
We, ....., as the Yang di-Pertuan Agong of Malaysia, are truly grateful to God the Almighty, the Blessed, because of this election to the honourable office of the Yang di-Pertuan Agong has happened because of His Benevolent Grace. Therefore, we shall justly and faithfully perform our (my) duties in the administration of the nation of Malaysia, in accordance to its laws and its sacred constitution, shall protect the Islamic religion at all times as mandated, and shall duly fulfil the rules of law and order and promote good governance in our country.”

In the oath that the King took in the presence of the
holy Quran, he acknowledged that the constitution is sacred. He promised to
protect the Islamic religion and promote good governance.
The Constitution is so thorough that it even makes
provision for the post of the Raja Permaisuri Agong.
Article 32 (2) of the
Constitution states: “The Consort of the Yang di-Pertuan Agong (to be called
the Raja Permaisuri Agong) shall take precedence next after the Yang di-Pertuan
Agong over all other persons in the Federation.”
Well, it is only natural that when there is a King, there
shall be a Queen.
To further protect the royal institution, the
Constitution was amended in 1993 whereby the immunity of the Rulers was clarified.
The Rulers are protected from prosecution and liability in the performance of
their official duties.
But they were no longer immune to prosecution in the
conduct of their personal affairs like cheating their business partners or
roughing up a hockey coach.
Even so, in recognition of their special position, they
will not be tried in the ordinary court of law. A special “royal court” would
be instituted to try them.
Since then, one libel suit had been brought against a
Malaysian ruler – the Sultan of Pahang – and was tried by the Special Court of
Malaysia.
However, the trial did not proceed when the court ruled that a foreigner could not
bring a suit against Malay rulers. The plaintiff was a Singapore businesswoman.
In conclusion, our CONSTITUTIONAL monarch has nothing to
fear if they understand their special position and stick to their duties as
spelt out by the Constitution.
The people expect them to be the embodiment of all things
good and holy. But the question is: Are they?

ReplyDeleteTK.. gelap pemandangan saya, bila TK tulis belanja mem-bela sorang Agung untuk 16 bulan terakhir sehingga April 2018, berjumlah RM256.9 juta.. mentederah apa tu?
Ini bermakna rakyat kena sediakan RM16 juta sebulan.. lebih setengah juta hinggit sehari.. phooooh. Aku soru pun kekadang tak tepat.. ikat perut lagi.. kerje dah tak menentu.. kan negara dah semakin sengkek?
RM16 juta tu kita boleh nyiapkan 400 hingga 500 bijik rumah rakyat sebulan dan rumah ini kita beri cara percuma pada yg memerlukan.. setahun dah berapa bijik.. 5 tahun?
Tu sebab di Kanada dan negara seangkatan dengannye boleh beri rumah percuma pada rakyatnye yg memerlukan. Itu lah antara impak sosial yg kita patut dah mula fikirkan.
Keperluan tempat tinggal amat mendesak sekarang ini. Tak percaya jomm kita minta Agong, yang dilaungkan berjiwa rakyat itu, berjalan kaki pada senja dari Komplek Pertama.. lintas Chow Kit hingga penghujung JTAR.
Lihat lah gelangdangan bagai ulat tahik membentang pelapik untuk nyediakan tempat tidur mereka.. ini bukan dongeng?
Seingat saya prihal gelangdangan tak wujud ditahun 70an..80an..90an.. antara sebabnye rakyat boleh pacak rumah kilat.
Bila UMNO sedar betapa tanah sgt bernilai dan boleh beri kekayaan.. maka mereka terus tegas tak kasi rakyat pacak rumah. Dan mereka mula nyapu tanah2 ini dgn semahunye.. klimaknye .. itu lah yang dilakukan oleh Najib..
Jadi ..bulan ni.. ada tak RM16 juta untuk belanje Agung.. duit tabung pungut utang Najib khabarnye dah cecah RM18 juta.
Itu baru satu Agung ..Raja-Raja yang lain berapa belanjenye Tok?

DeleteWhat I like about the current situation is that despite the euphoria over the historic victory, the rakyat is no mood of letting up. They are monitoring everything and are ever alert as to whether PH has deviated from its manifesto. This is healthy. It puts everyone on their toes. Its good for PH because it actually helps PH fulfil their promises, which will of course be a positive factor come PRU15. Its this monitoring from the rakyat that has forced DSAI to defend himself. His meetings with the kings have generated a lot of suspicion. The rakyat will not tolerate any hanky panky.

- and, Datuk expect people like me to contribute to Tabung Harapan Malaysia, otherwise someone will label me unpatriotic Malaysian?
- how much Agong contibute Datuk?
- does he say anything?
- may I suggest to cut his expenses by RM10 (ten ringgit) and contribute it to the Tabung?
- then, increase Agong's expenses to RM350 million per year to compensate for his loss of income...how's that?
- that will make Datuk AKJ and all the Melayus in Malaya very very happy.
- the Agong needs millions to protect Islam and the Melayus, mind you...so Cash is really the King after all.
Better use the tabung Harapan money to clothe the poor and homeless for Hari Raya, Deepavali, Christmas, Chinese New Year, the Gawai, Hari Keamatan and Thaipusam. The sun is too small to pay off the nattional debt.

This is not the case. The constitution is not a point of reference for most Malaysian especially Malays.
The constitution state the function of Government, the Royals, and the rights of the people.
Our constitution derived from the British. There are a lot of similarities with regard to the government structures, the royals, and the rights of the people etc.
I lived in the UK for a few years. There is no problem with the British. They know that the one truly in charge is the Prime Minister. The vast British population are mostly educated and they understand their rights.
Things somewhat differs in Malaysia. The Malays still hung on to the feudal thinking. There are words used such as "Mengheret", inappropriately used and most of the time by those who tune to their own polical milage or vested interest.
I think the most important things is "education".
I think , the fundamentals of our constitution have to be thought in school so that the rakyat understand their rights, the function of the royalty , the government and so forth.
In America, their constitution were thought in their school. The declaration of American Independance, the 1st and the 2nd amendment of the constitution. That is why they are very clear about their rights as citizens.
It is time we do the same.
You are very wrong there. The British PM has to report to the Queen..every week.

ReplyDeleteOut of curiosity. Why hasn't the Goebbles of the last administration been caught and served their justice yet? At the very least, they should be prevented from continuing their (now subversive) activities against the new government.
A Process Must Serve Its Purpose
ReplyDeleteNotwithstanding the constitution that says the YDPA shall appoint the AG upon recommendation of the PM we must also look at rules from the spirit of the rule itself and the purpose of the process.
First, the purpose of having AG (the judiciary institution) the YDPA (an institution by itself) the parliament and the executives (The ministers led by the PM) is to provide a check and balance through balance of power.
Having said that, PH promises an institutional reforms of which will uphold the concept of separation of power of which also means the appointment of the AG must not be influenced by the PM. If it does, then we are back to square one, no difference from the previous government whereby the AG is perceived as highly influenced by the PM or the executives instead of being independent.
So the spirit of the rule and the reforms is to have an AG that is independent from the executives. How can AG be independent from executives if the appointment is made by executives itself?
As such, the purpose of the rule which will serve its purpose is the recommendation of AG candidates should be done by the Parliament select committee with a list of names to be presented to the YDPA. YDPA shall in turn use his own wisdom and his advisors not from the executives or the Parliament (perhaps majlis raja2) to select one candidate among the list. Being above politics, the choice of the YDPA will be deemed neutral. Isn’t that what we want? A neutral AG that can serve without fear or favour?
My conclusion is, with regard to the process, if the AG, a sole candidate recommended by PM only need to be endorsed by YDPA, the process does not serve its intended purpose.
The same should apply on the appointment of MACC Chief, the police chief as well as the special branch chief.

Pada aku, ulaihsan Sayyid Qutb sangat 'best' pasai dia bincang kemunkinan unjoran 'meneguhkan kedudukanmu'
mai diujong ayat pada hai kalu ikot lojik biasa, 'pengukohan' perlu (sangat2) di awai pejuangan. Ini mai di ujong pulak.
Menurut Sayyid Qutb, munkin dua pekara :
1. Lepaih sesatu 'kemenangan', maknusia menjadi lebih rilek ('take it easy') dan mengurangkan kesiapsiagaan
(let the guards down) lantaih tededah pd serangan balaih oleh seteru, munkin macam dlm cerita petemporan di Bukit Uhud.
Lagi pulak, kebiasaanya, maknusia lebih payah hadapi ujian dlm bentuk kesenangan bebanding kalu depa diuji
dgn kesusahan, dan
2. Lantaran masa menhadapi ujian yg petama, kadag keyakinan (untuk capai kemenangan) munkin 50:50 saja,
dan lepaih dikecap kemenangan, semangat juang naik mendadak, makanya 'pengukohan' datangnya selepaih
petolongan Allah (seperti didalam ayat 6 tu).

I think Tun M is a minority PM. PPBM has only 12/13 parliament seats.Maybe d Ruler's fear of PPBM being controlled by DAP is legit.

ReplyDeleteIronically given your background as an influential member of the 4th Estate, you DID the very thing that you penalise NST for by highlighting the expense of the Agong. Sinister? Wallahualam.
But being the good friend of Tun, I would appreciate if you do not add on to the call for the Royal House to tow the line. After all, as you mentioned, they are very much of their position in the constitution. Alas, my fear in your rush to display to Tun your unwavering support for him may make Malays even less secure/nervous in the new Malaysia.
Perhaps a more positive and/or less sinister tone could help ease the situation which may court another round of crisis when there are far more urgent matters need addressing during this interesting times we are in.
A press differing, as what you perceived, is the very thing we look for in the New Malaysia. Don't fault change just because it doesn't augur with your views.
Its not about the 'unwavering support for Tun' you dumbo..its about the royals antics of foolhardy needs to be checked..and yes EVERYTHING must change for d sake of Malaysia now ....esp d 'kissing of hands'

Kalau 2....memang masalah.
Contoh ketara....bila Bugis menjadi nakhoda yg rasmi memerintah negara.....bini pula nenjadi nakhoda dibelakang takbir....akibatnya....Negara kena klepek berbilloin2.
Kalau PH sudah ada PM sbgai nakhoda.....apa perlu seorng nakhoda lagi.
Sepatutnya ....selepas melalui 1001 mcm dugaan dlm hidup....Anwar patut bersyukur dan berterima kasih pd Tun dan semua terlibat dlm kejayaan PH mengambil alih Putrajaya....justeru memahami kedudukan diri.

Dia wajar tahu 'tempat' dia....dan apa2 alasan pun rakyat yg menyokong PH dan Tun tidak dpt menerima.....kerana faktor Tun lah BN Umno tewas dgn teruk.....dan dia dibebaskan dgn kadar segera dan isteri menjadi Timb PM wanita pertama negara.
Dia jgn menjadi Melayu atau spt Melayu2 Umno yg tidar sedar diri.....hingga Melayu2 lain menghumban parti kedlm longkang.
Nmpk mcm dia perlukah berlajar lagi pula....mungkin kerada dikurung agak lama dan pergerakan jadi serba tak kena pula bila mdpt kebebasan mengejut.
Apapun Tun M kena mengambil langkah berjaga2 kerana org ini cakap lain buat lain.
Terkejut dgn apa yg berlaku sekarang.anwar tahu melayu mudah lupa.

ReplyDeleterecent events over the appointment of the new AG certainly buttressed the rakyat's perception of palace interference in applying the rule of law and of the federal Constitution. True or not does not matter any more. Respect for the country's constitutional monarchy system has been severely damaged. This was a self inflicted wound.
Something so simple to understand and comply with, why did these delays, night visits by Anwar to the Agong, etc. happen?
Rais Yatim said in his tweet today : “Majlis Raja-Raja Melayu (the Conference’s official title in Malay) has no designated role in the matter of who should be the AG.”
He, however, pointed out that it is within the rights of the Rulers to question the Yang di-Pertuan Agong for ‘delaying’ the appointment of the AG, after the incumbent Tan Sri Apandi Ali was ordered to go on 30-day unrecorded leave beginning May 15.
“They have every right to question the Agong why he conducted himself the way he did in delaying the appointment.
Why did the Palace announce that a special ROC would be held today, and then this morning the ROC meeting was cancelled. Dreadful waste of time or not?
Rule of law and respect for the Federal Constitution governs the monarchy and the rakyat. There are no exceptions, so let this be the new mantra of the new govt.
Next time, royal consent to appointments to the Cabinet and other institutions should not be held up again.

The British PM also has to be in the Parliament without fail every Wednesday noon to answer questions by MP.
The Queen do not go against the will of the British people.
She never asked two names and then select one of them or flexing her power to the people.
The Queen of England never announced to British people that she prefer one party over another.
If you ask any chaps in England, who run things in UK? They will say Theresa May.
I can add many more comparisons but, looking at the outcome of yesterday, which was a relief , these will suffice.
By the way, James Bond is under the Queen's Majesty Secret Service. If you watch the films, James Bond never met the Queen, most of the time he met Moneypenny.

Umum mengetahui tentang perjanjian PH bahawa jawatan PM akan disandang beliau dlm masa 2 ahun...tetapi buat seketika ini dia wajar 'toe the line'... dan memelihara 'decorum'.

Mana mungkin dia tidak tahu....tetapi kerana terkurung lama....dan kebebasan mengejut menjadi org ini agak gelojoh.

ReplyDeleteMasyarakat kita tenat. Terlalu mengagungkan darjah kebesaran seperti Datuk/Tan Sri. Ianya adalah anugerah bukan untuk digunakan dalam kehidupan sehari-hari. Bila bercakap, disapa2 Datuk. Yang disapa menjadi megah. Orang bila dengar seseorang itu ada Datuk, terus jadi menikus. Datuk is to be used a salutation in letter. Ni orang guna gelaran Datuk macam nama sendiri. Di social media, di poster, di tandatangan, di senarai nama. Masyarkat kita dah jadi kucar-kacir dengan Datuk ni. Bila dengan orang ada Datuk, terus jadi kecut. Automatic respect tanpa tahu apa Datuk tu buat. Perubahan juga dapat dilihat. Dulu tak ada Datuk, sekarang ada Datuk. Interaksi terus menjadi berbeza dengan colleagues and kawan2. Bila bercakap kena sapa Datuk diawal/diakhir ayat. Sangat mengjengkelkan. Begitu juga dengan panggilan waibi-waibi. Kenapa tak seragamkan sahaja biar semua orang disapa dengan panggilan Tuan/Puan walaupun ada Datuk? Di UK juga ada anugerah Sir. Tetapi tidak pula dipanggil Sir atau nama mereka mahu ditulis Sir disemua tempat. Di Malaysia, kalau boleh nak semua orang tahu dia tu Datuk. In Malaysia Baru, please stop this nonsense. Everyone must be addressed equally as Tuan/Puan. Tak perlu lagi nak panggil2 Datuk. And tak perlu di semua cetakan nak tulis Datuk tu. Amat menyedihkan dengan perkembangan sekarang. Individu berbangga dengan gelaran Datuk dan yang tak ada Datuk terus bagi automatic respect kat orang2 Datuk just because orang tu berdatuk. Hope in Malaysia Baru. This will be a thing of the past. Address everyone equally. And please fight for this first. Haramkan penggunaan Datuk ditempat awam tanpa kawalan. Malaysia Baru tidak memerlukan kasta. Dan lahirkanlah generasi yang saksama dan bukannya generasi yang bangga dengan gelaran Datuk dan generasi yang takut atau segan dengan orang yang ada Datuk. Not too long ago , DSAI and PKR were still not sure about Tun M's commitment to full reforms.
They have made reforms of key insititutions as one of the conditions in accepting Tun as PM candidate.
What you just wrote seems to throw them back the challenge..are they ready for full reforms..
Today majority of Rakyat Malaysia are ready..

ReplyDeleteI read the recent comments by Kadir Jasin on 'The King and The Pauper' and found them interesting. From my perspective, I am unclear about many things. It could be due to ignorance or it could be due to lack of clarity on what actually some features of the Constitution represent. Many aspects of our Constitution have not really been made explicitly clear and free from ambiguity. However, what I do know as a Muslim and non-Malay, that every country/nation has exclusive rights. For example, China holds the Han to be the rightful people of that nation. Likewise, Malaysia has its Bumiputra status, royalty etc. As a non-Malay, this is fine and understandable to me. Even in Islam, (I am a qualified Islamic scholar), equality takes not a different perspective. A man and a woman are equal through different rights. Therefore, when it comes to Malaysia, we are Malaysians, but let us not get carried away with equality. Even China does not tolerate such! However, what really concerns me is this: "If you claim this country to be yours, that's fine with me, but for God's sake, PLEASE do a honest job of serving this nation and the interest of all its citizens! Enough of free-loaders and self-enrichment. The world has changed and we need to adapt, but adapting does not mean giving up moral righteous principles.

The budget for the royal household is, I presume, public money and thus auditable like all other pubic funds, and subject to scrutiny regarding compliance with the rules governing procure by public agencies.So while the king may get to "live like a king" he needs to manage his spending like a government servant.

Sebenarnya, Raja-Raja telah melepas kedaulatan Negara, termasuk Institusi Raja-Raja, apabila menanda-tangani surat-perjanjian, bersetuju dengan hasrat Penjajah British menjadikan Negara kita, 'Malayan Union' pada 1946.
Disebabkan itu juga, UMNO tertubuh untuk mengerakkan Rakyat, terutamanya Melayu, yang sangat kecewa supaya bangkit membantah Malayan Union, dalam perarakan besar-besaran seluruh Negara. Nasib baik Penjajah, back-down dan Malayan Union dibatalkan.

Hakikatnya, semasa cadangan penubuhan Malayan Union, Rakyat telah 'menyelamatkan' Institusi Raja-Raja dari diperkotak-katikkan oleh Penjajah British. Nampak jelas ketika itu, Raja-Raja amat 'takut' dengan Penjajah British.
Yang peliknya... kalau dulu mereka boleh terima 'nasihat' British, mengapa hari ini, seolah-olah, liat untuk memperkenankan hasrat PM yang menjadi pilihan majority Rakyat?
Nota: Sebelum PRU 14, Rakyat sudah tahu... jika Pakatan Harapan mendapat undi paling banyak, Dr.M akan menjadi PM.

ReplyDeleteWe need transparency, if our Sultan's continue to act as they are the instituitions they represent will only get weaker.
A lot of the usual aloud voices and Daulat Tuanku being shouted.
But our Sultan's are only human, not beyond reproach and criticism.
Criticism should strenghten and improve things.
No one should be afraid of criticism.
Let us work together to improve our instituitions and not continue to hide them in darkness.
If all you complaining that the Royal Instuitions cannot be criticised and they are held in high regard, please go to the ground and listen to what people actually think especially in Johor and Pahang, where some harsh medicine is needed in order for our royal institutions to regain their credibility.
