Najib’s Trial: Justice Delayed Is Justice Denied

PREAMBLE: Views expressed herein are entirely mine. I am writing in my personal capacity as a blogger. It has nothing to do with whatever position I may hold.

Najib prays. But the people have prayers too.
WE are often told that justice delayed is justice denied and justice is not only for the victims but equally for the accused.

In the case of the Public Prosecutor vs (Datuk Seri I Mappadulung Daeng Mattimung Karaeng Sandrobone Sultan Abdul Jalil) Mohd Najib Abdul Razak, a delayed justice affects the people as much as the accused.

Malaysia has become the laughing stock of the world. The 1MDB case has been variously described as the biggest heist in history.

Thus far justice remains undone. Instead what we see is the opposite - the injustice to the country and its people.

Whereas the public has suffered the consequences of the alleged misdeeds of the accused, the man himself continues to lead the life of comfort and privilege.

Unlike other alleged offenders from the previous administration, Najib was not kept in the MACC’s lock-up and was exempted from wearing the commission’s orange-coloured attire.

Instead he was treated like a VIP. Compared to the crime he was accused of committing, he was let loose on minimum bails.

What is a bail of RM1 million or RM2 million to a man who is being accused of stealing billions in public funds?

On whatever grounds that his trial is delayed, the fact remains that justice remains undone.

For Najib, justice is denied because it delays his chances of proving with reasonable doubt that he is not guilty of all the crimes he is charged with.

For Najib’s supporters, justice is denied because it delays the fullfilment of their hopes and prayers that their beloved “Bossku” would soon be vindicated.

For Najib’s detractors, justice is denied because it delays their hopes and prayers of wanting to see him dispatched to Sungai Buloh for a long time.

We can only hope and pray that the learned judges, the public prosecutors and the defence counsels have as much concern for the interest of the public as they do for Najib.

Najib is not an ordinary chicken thief. Nor is he a poor uneducated man who stole a loaf of bread from a supermarket to feed his hungry children.

Najib is not a good-for-nothing “kamjat” from the backstreet of Georgetown, Penang or a ganja-induced mat rempit.

He is an aristocrat who was born with a silver spoon.  He is an educated man. He said he has a degree from an English university.

At 23 he became a member of Parliament uncontested. At 29 he became the youngest Menteri Besar in history. His passage to the top was facilitated because he is Tun Abdul Razak’s son.

He doesn’t need to bother about making money. As he once told us in the early days of the 1MDB scandal that his wealth was the product of legacy.

If you are old you know that his grandfather on his mother’s side, the late Tan Sri Mohd Noah Omar, was a fabulously wealthy man.

Together with the late Tan Sri Lim Goh Tong he pioneered the Genting Highlands Casino.

If you are young and are promoting his “Malu Apa Bossku” roadshow, you better make an afford to know who this capo dei capi is.

I am both lucky and unlucky to have known him since 1977 when I exclusively interviewed him for the Business Times newspaper on occasion of the 1st anniversary of his election as the MP for Pekan, Pahang.

As for his new found fame as “bossku”, only a thief would say to his boss who is caught stealing “malu apa bossku” (what is there to be ashamed of my boss).

The Magna Carta say, “To no one will we sell, to no one will we refuse or delay, right or justice."

    Salam Dato,

    PH government is in charge! What else you want me to say! Everyone must accept court’s decisions no matter how “shocking” the decision is. Certainly Najib’s case cannot be concluded as fast as LGE’s case. I hope thats not everyone’s expectations!

    like the way you describe that person:

    The issue is he is making himself out to be all of the above and diavowing his inheritance of name, lineage and birth.

    So to the judges, prosecutors, understand now that you are dealing with the rakyat who will scrutinise your every move. With the explosive bombshell by the sitting COA judge on shady deals and decisions at the top echelons of the judiciary, do not even try to curry favour with Najib and his team.
    Do not deny justice to the rakyat because karma will get back at you and it is now a given that you will be investigated and the rakyat will be on your duplicity in an instant. Fair warning to these learned people!

    Dato’ ni balik-balik asyik cakap tentang Najib je. Please la Dato’. Macam budak kecik, asyik nak salahkan orang lain je. Jadilah matang sikit macam Tun Dr Mahathir. Beliau sedar partinya BERSATU tidak kuat dan nyawa-nyawa ikan. Dan kalaulah kalah PRK Semenyih ni …… habis !!!!!! Cepat-cepat Tun Mahthir buat taktik berkawan dgn PAS atas dasar Melayu memerintah. Nampak tak stratergi Tun Mahathir. SMART guy.

    Cubalah Dato’ cari idea sikit macam mana nak kuatkan BERSATU. Dengan pemimpin kanannya yg menipu ijazah, berkelahi semasa sendiri tentang projek, budak mentah dijadikan Menteri. Apa mereka semua buat atau sumbangan mereka untuk kuatkan BERSATU ???? Orang bantai BERSATU, seorang pun ahlinya termasuk Dato’ sendiri tak berbunyi. Ambiga kutuk BERSATU. DAP kata BERSATU kutip sampah, PKR tak habis-habis suruh Tun turun cepat utk digantikan dgn Anwar, orang BERSATU buat apa? Tidur ke ?????

    Akhir kata, BERSATU ni rasanya hanya harapkan Tun Mahathir seorang je. Kalau Tun tiada lagi, rasanya berkuburlah BERSATU. So, please Dato’. Cukup-cukuplah strategi salahkan Najib, carilah stratergy baru pula. Saya memang tak suka Najib, tapi tak bolehlah nak menyalahkan Najib dlm segala hal terutamanya BERSATU itu sendiri pun nyawa-nyawa ikan. Maaflah kalau keras sikit. Sekian TQ..

    Datuk,
    Putrajaya said it would not extend its moratorium on bauxite mining which ends on March 31 due to strong demand for the industry, state news agency Bernama reported on Monday, quoting the water, land and natural resources minister.

    Malaysia was once the biggest supplier of bauxite to top buyer China, with shipments peaking at nearly 3.5 million tonnes a month at the end of 2015.

    Bauxite is mainly used as an ingredient in the production of aluminium.

    But unregulated mining and run-offs from unsecured stockpiles in the eastern state of Pahang contaminated water sources, turning roads, rivers and coastal waters red.

    The most critical and harmful aspect to humans is that exposure to the mining processes and stockpiles, the contamination of the ground and water, leads irretrievably to cancer!

    Xavier is talking with the $$$signs in his head and mind. Does he not care about the health of the rakyat? Is money generation more important than the lives of the rakyat, Xavier?
    Take care, we elected you in, we will elect you out! Your handling of the natural resources in Johore reflects so badly on you.

  9. That man does not walk free who meets his own ghost wherever he goes. He seeks illusory adulation and public attention to keep his sanity so that he can legally stand trial. Otherwise, if his lawyer pleads insanity on his behalf, we will miss the trial of the century. Only a little longer will he taste the false freedom of putting on a carefree facade. His days are numbered. If ever he, his wife and others can assure themselves of real freedom, then the government of the day is not worth its promises to the nation, and the nation is not worth boasting about on the world map. Indeed, then, the nation will be the laughingstock of the world, what with the legal malfeasance committed at the highest echeleon of the judiciary, and will continue to be committed, if not eradicated via the highly recommended RCI of late. The New Malaysia with the arisen loud public consciousness is a force to be reckoned with, worthy of its respect and informed views. That is the direction and the path, in which and by which New Malaysia must and should walk.

      @Amigo, yes Malaysia is already a laughing stock in the eyes of the world even without 1MDB. Minister Of Communication has hinted press freedom is “dead” in Malaysia since it is compulsory for RTM (tax payer’s $$$) to report another DAP minister’s event.

      Yes, our leader promised to sign ICERD treaty in UN but it lierally stopped there in UN !

      How about death penalty and Sedition laws that we loudly promised will repeal ! Sorry world, we changed our minds cause in Malaysia we value politics more than our trustworthy!

      Sh.... we don’t intend to fulfil our promises in election Manifesto too cause it is not a Bible! Aiyah, Malaysia no money lah! We can’t even start our pet car project !

      @Amigo, I reckon you should read more about Malaysia’s current affair news daily so that you get a more complete picture of the new world called “Malaysia Baru Tak Akan Datang”!

    Dekat Amerika Syarikat, pelakon terkenal Leornado DiCaprio pun sudah dipangggi untuk memberikan keterangan berkenaan dengan 1MDB.

    Di Malaysia ini belum berjalan lagi perbicaraan. Walhal duit yang terlibat sampai berbillion adalah dari Malaysia.

    Adakah ada keutamaan dalam perbicaraan mahkamah, umpamanya, orang yang curi seribu ringgit dan berjuta-juta ringgit? Adakah turutannya sama saja atau yang berjuta ringgit dipercepatkan.?

    Saya terbaca ada peguam di antara pembahas dalam blog ini, mungkin boleh berikan pencerahan (selagi mana tidak menghina mahkamah).

    Baru-baru ini Bill Gates, pencipta software "Windows" dan di antara orang yang paling kaya di dunia mencadangkan rakyat Amerika baca buku "Billion Dollar Whales" berkenaan kes tipu 1MDB.

    Dekat Malaysia ini "Malu apa Bossku".

    Shukur Alhamdullillah MACC sudah mulakan siasat kes RM90juta dan PAS.

    Kalau orang Kapir, berbohong walaupun ada orang buat, tapi orang kapir masih kata bohong itu salah dari segi moral dan undang-undang.

    Kalau ajaran Nabi Muhammad, berbohong itu berdosa dan boleh masuk neraka.

    Kalau PAS pulak, mengikut berita, setelah audio Nik Abduh didapati sahih apabila disiasat oleh orang kapir di negara kapir, PAS kata berbohong itu dibolehkan.

    Kalau berbohong itu dibolehkan oleh Parti PAS, macamana nak percaya cakap PAS kerana mengikut PAS, berbohong itu dibolehkan.

    Ini persoalan pertama.

    Persoalan kedua, kalau benar PAS terima duit UMNO. PAS buat apa dengan duit itu?

    There is a famous phrase in a case judgement which reads as:
    "It is of fundamental importance that justice should not only be done but should manifestly and undoubtedly be seen to be done."
    The point of this is that in order for justice to truly be justice; a trial needs not only to be fair, just and unbiased, but it is of the essence that these things are also seen to be fair, just and unbiased.
    This judgement is aimed at all professionals in any way involved in administering justice - judges, clerks, lawyers, police - who are required to pay attention to this principle when performing their jobs.
    In this regard, this principle is most relevant in the trial of Najib Razak. Failure to adopt this principle will lead to unfair, unjust and biased justice. Ultimately justice denied.

  14. 'If your ship doesn't come in, swim out to it', perhaps this is exactly what the self-claimed thief of the people's hearts does, in order to survive from day to day basis. After being pushed off, it is understandable under such circumstance leaving him not many choices but must put a brave face on waddling his way back, all on his own, to the centre of public attention again. He certainly understands well that he desperately needs to regain some level of support prior to his multiple-charges-laden trial. Unexpectedly, he has succeeded by far. All thanks to the harum-scarum Malays, in particular, potty about his latest zany character, and readily to respond to all his 'huhahuha' queasy walkabouts. But, it is an unfathomable reality that it takes a split second for these people to forgive and forget the biggest heist in history in the universe. What is the world coming to? Huh?

    Back to the point. Where does he get the 'lawan tetap lawan' inspiration from? Didn't the trial postponement bring back some familiar recollections to us? Certainly phony excuses will be proffered as he has been trying hard to copy whatever his best reformist buddy had done in the past, delaying and aiming to get off the hook. By the way, that reformist has no right by all means to comment on the statement made by PAS lately; simply because he himself was once the nation biggest liar of all and still is. To date, he always keeps something up his sleeve when it comes to personal ambitious agenda. To Tun M, be prepared and all out for a real struggle if the rumour of no-confidence vote really takes place. An anxious non-entity like me just can't wait to witness how Tun is going to remove the irritating thorn in his flesh for the last and final time, once and forever. Let's see who will have the last laugh in the very end.

    in the Seminyeh by-election, the PH candidate Aiman does not need to apologise for the banners/leaflets that have sprung up. Pictures of handbags and watches accompanied by their prices, as well as of police carting away boxes of the handbags during a raid, remind Malaysians not to forget Rosmah Mansor’s excesses.

    Nothing wrong with that. Aiman are you immature?
    Fight fire with fire, for too long PH has been too polite in the face of UMNO/PAS insinuations and lies.
    Najib goes around parading himself with Malu apa Bosku, making a mockery of himself and his supporters.

    The rakyat views the courts, prosecutors, judiciary, MACC, PDRM, Parliament as too soft and accommodating with the Najib and his team.
    So better buckle up and do your job instead of granting more and more delays to the billion dollar whales and pirates.

    Datuk,
    Datuk Seri Dr Ahmad Zahid Hamidi was slapped with another charge at the Kuala Lumpur Sessions Court on Wednesday for criminal breach of trust.

    The Umno president was accused of using RM260,000 of Yayasan Akal Budi funds to make a payment to TS Consultancy and Resources on Dec 23, 2016.
    Dr Ahmad Zahid, who is the chairman of the foundation, was charged with committing breach of trust (CBT) under Section 409 of the Penal Code, which carries a maximum of 20 years' jail, whipping and a fine, if convicted.

    Okay, sure, charge him, however make sure the charges are not transferred here and there thereby thwarting justice and causing delays after delays.

    Prosecutors, decide where to charge the parties like Najib, Rosmah, Zahid and their lanun lanum, and go ahead and see them in court.
    You can add more charges later.
    A conviction of even a couple of charges will see them in prison first which is where the guilty belong.
    Then follow up with more cases in court. Let them feel the "burden" of justice.

    Bersatu should fight back. Juallah T-shirt dgn tulisan "APA MALU BOSSku, MARI KITA CURI LAGI....MELAYU BANGGA JADI PENCURI"...or something more catchy.....

  20. Let the RCI wait its turn5:27 PM

    Datuk,
    the first order of business for the AGC and the judiciary is for the charges against Najib, Rosmah, Zahid and the rest caught with their pants down to be heard and tried in court.

    It is definitely reassuring for the AG Tommy Thomas to state clearly that all court cases will proceed as usual when the royal commission of inquiry (RCI) carries out its probe on alleged misconduct in the judiciary.

    “All cases at all levels of our superior and subordinate courts can continue to be heard and determined by them,” he said in a statement.

    His clarification came following the government’s decision to form an RCI to probe accusations made by a Court of Appeal judge.

    Thomas said no cases will be postponed without a reason during the RCI probe.

    Let no presiding judge or prosecutor use the excuse to recuse himself or herself just because of the RCI probe.
    If push comes to shove, the RCI can and should take place at a later date.
    Let nothing interfere and come between the alleged criminals who are and will be tried in court.

    So to those who want the RCI, understand that the first priority is and will be the court cases! Do not let yourselves be side-tracked and lose sight of the goal.
    Cows may come and go, but the buffaloes must be caught and tried.

    MACC, PDRM, AGC and all are fully aware of their roles, responsibilities, and priorities.
    The sitting judge COA whose affidavit started the ball rolling and his supporters have to take their turn in setting up the RCI.

    The rakyat has already seen the numerous attempts by Najib, Rosmah and their lawyers to stall the cases to be heard, delays after delays, postponements after postponements given to their trial dates. It is simply not acceptable now. No more excuses.

    Tun, AG, take your sweet time to set up the RCI. It is secondary, not do or die effort, and can wait.

    Datuk,
    the PH bigwigs are out of their minds. Flirting with danger, the risks are so great.
    The ECRL is a dead project, let it remain dead.
    Why waste time and effort fighting for a bigger reduction in price?
    Along the way, many calculated mishaps will happen, then what is feared will happen.
    The Chinese will ask for further concessions, ask for further extensions, ask for further consideration of the prices, ask for price hikes, ask for this and that.
    Can the PH govt afford this kind of delay and scare tactics when the project is halfway or even three quarters done?

    I can already predict the Chinese will have the balls of the PH govt twisted and stretched that there is no way to deny the bloody Chinese their demands.

    The ECRL is DEAD, let it remain dead. Nothing good will come out of this project.
    Why is Daim, LGE and even Tun even reconsider their flat out rejection?

    Listen to the voice of the rakyat. We don't want the ECRL.

Several voters in Semenyih whom FMT spoke to earlier this week said PH’s failure to fulfil its election pledges and tackle such issues could affect its performance in the upcoming by-election for the state seat.

    But others say Barisan Nasional (BN) is simply the more popular choice, even with the scandals that have been swirling since PH took control of Putrajaya in the May 9 polls last year."

    Reality bites.

    Hence there is an urgent need to look at that manifesto again and to TRACK what can be done, and then COMMUNICATE that to the public.

    Otherwise the "Broken Promises" albatross will ensure this is a one-term government.

    Please also get communications team in place - an extensive and capable one.

    This is not the 1980s era of a passive populace tied to newspapers, TV and radio.

    Today's fight is totally different.

    Standard Pemimpin Melayu dalam BERSATU

    Pagi ni saya ada terbaca kenyataan terbaru Dato mengenai demokrasi. Tak apa DAP kutuk Tun Mahathir dengan alasan demokrasi. Aduh !!!!!!! Malu saya ada pemimpin macam ni !!!!!!

    Ini bermaksud, Dato’ sebenarnya tak layak lagi join politik yg mewakili orang Melayu. Demokrasi tu kata, bila orang kata dekat kita, kita ada kekuatan untuk defend balik. Ini DAP, PKR, Ambiga bantai Bersatu, Dato’ dan BERSATU buat apa. Takutla tu. So. Sekarang faham tak maksud KORO yg kena pada batang hidung sendiri.

    Hang Tuah, Hang Jebat, Tol Janggut, Dato’ Bahaman, Mak Kilau, Dato’ Maharajalela dan beberapa lagi pemimpin Melayu yg terkenal dengan keberaniannya sehingga sanggup mati mempertahankan Melayu. Sekarang Dato’ nak mempertahankan boss sendiri pun takut? Mana semanagat pepatah biar putih tulang, jangan putih mata dalam BERSATU ????

    Akhir kata, habis tu, macam mana orang Melayu nak jadikan BERSATU payung mereka selepas ni? Please, jangan buat macam ni lagi ye. Malu saya Dato’. Maaf cakaplah, tapi rasanya eloklah Dato’ join NGO je. Itu lebih bersesuaian denagan Dato’. Sekian TQ.

    1. Yang koro tu okj. Sebab perangai macam ni lah umno tersungkur. Sebab mempertahankan pemimpin membuta tuli at the expense of institusi.

      Sekarang nak tuduh ph tak mempertahankan melayu dan islam. Sedangkan kalau umno buat kerja betul2 sepanjang 61 tahun memerintah, tidaklah orang melayu bak melukut di tepi gantang.

      Melayu dan islam hanya jadi alat pemimpin umno untuk mendapat sokongan. Tapi bila berkuasa, digunakan untuk mengkayakan diri sendiri dan anak beranak. Rumah sensiri lagi gah dari pejabat umno yang uzur dan usang.

      Sudah-sudahlah mengata orang lain. Kalau umno dan pemimpinnya ikhlas bekerja dan berjuang untuk rakyat, berkhidmat dan berbaktilah walau tiada jawatan. Dulu tu masa memerintah bukan hangpa yang berkhidmat sebab semuanya jentera kerajaan yang buat. Hangpa puak-puak umno semua berpaut je untuk mendapat nama dan kesenangan dari program yang kerajaan jalankan menggunakan duit rakyat.

    JUDGES will retire at 66 as Putrajaya has no plans to extend the retirement age to 70 despite senior judges seeking such extension.

    The government has no plans to table a bill to increase judges’ retirement age from 66 to 70, de facto Law Minister Liew Vui Keong told The Malaysian Insight

    Disagree with above. The govt should allow for mutual voluntary agreement of eligible judges to extend from service 66 years to 70 years, if one party does not agree, then its 66 years.
    Currently we have some senior judges who are not tainted with the previous govt's tar brush and the country needs them to perform national service for the rakyat.

    Sy ingin mengutarakan pendapat berhubung Suruhanjaya Diraja bagi menyiasat badan kehakiman, sy ingin cadangkan supaya RCI tersebut turut menyiasat bekas2 menteri yang pernah terlibat dalam portfolio undang-undang, peguam-peguam senior dan pegawai-pegawai Mahkamah.

    Sebenarnya, Mahkamah kita dah lama jadi macam sarkas, banyak perkara2 yang menyakitkan hati rakyat berlaku. 'Cash Is King' sudah lama bertapak di dalam Mahkamah kita. Undang-undang seolah olah ada 2 set, satu terpakai kepada semua orang dan yang keduanya pengecualian diberikan kepada mereka yang berduit banyak atau kenalan menteri2 tersebut.

    Lawyers today agreed that former prime minister Najib Razak has crossed the line in making public remarks on the court cases facing Umno counsel Mohd Hafarizam Harun and public relations practitioner Paul Stadlen.

    Lawyer Muhammad Rafique Rashid Ali said Najib was doing what he was good at by “playing to the gallery” and conducting a trial by media.

    “He risks facing a contempt charge for doing that.

    Charge him for contempt and jail him, even a week or two.
    Najib must know who is the boss now, justice is his and our boss, certainly not this person going around with the logo malu apa boosku.

    Impose an immediate gag order on him, cripple his bad intentions to show up the govt in a bad light. Why on earth give him so much leeway when to an ordinary rakyat this seems inconceivable.

    Start the ball rolling with the court cases, and if need be if there are further postponements, establish a special court to try all his cases. They are certainly justified in the light of his lawyers' crazy antics to delay the cases on silly grounds.
    Let us have no more circus.

    Extend the service terms of the current CJ and those honorable judges who did not fall prey to cash is king syndrome. We all know who are the good ones.
