Osman Sapian Letak Jawatan MB Johor

MUKHADIMAH: Pandangan yang terkandung dalam tulisan ini adalah pandangan peribadi saya. Saya menulis dalam kapasiti saya sebagai seorang blogger. Ia tiada kena mengena dengan apa-apa jawatan yang mungkin saya pegang.

OSMAN Sapian meletakkan jawatan Menteri Besar Johor semalam. Demikian disahkan oleh Perdana Menteri, Tun Dr Mahathir Mohamad hari ini.

Biarlah saya terus terang dan kalau hendak dituduh kejam (ruthless/cruel) saya terima.

Seperti kata ungkapan Inggeris yang dirujukkan kepada Shakespeare, “I must be cruel only to be kind.”

Untuk melakukan kebaikan kepada majoriti, saya terpaksa “ruthless” kepada sebilangan kecil yang merosakkan.

Kekejaman yang akan saya lakukan adalah saya tidak akan bersimpati dengan Osman jauh sekali membuat alasan bagi pihak beliau.

Saya berasa cukup yakin bahawa tekanan Pakatan Harapan (PH), amnya dan parti beliau, Parti Pribumi Bersatu Malaysia (Bersatu), khususnya supaya beliau meletakkan jawatan adalah tindakan bertimbang rasa demi kebaikan rakyat Johor.

Orang Johor berhak mendapat Menteri Besar yang mampu menaikkan maruah mereka. Menteri Besar yang mewakili keseluruhan rakyat jelata Johor dan bukan kelompok tertentu.

Apa guna mereka bermegah-megah dengan slogan dan identiti negeri kalau mereka tidak ada digniti.

Sistem demokrasi berparlimen yang kita amalkan memberi harga diri (dignity) kepada setiap orang yang cukup umur 21 tahun melalui hak mengundi.

Tetapi hak itu akan menjadi tidak berguna dan akhirnya hilang apabila wakil yang mereka pilih berubah daripada menjadi wakil rakyat kepada boneka pihak-pihak tertentu.

Justeru itu, kalau saya kejam dalam penilaian saya terhadap Osman maka saya juga akan tidak bertolak-ansur (forgiving) dalam harapan (expectation) saya terhadap pengganti beliau.

Kita tahu apa kesilapan dan kegagalan Osman. Antaranya beliau dilihat sebagai tidak mengutamakan kepentingan rakyat yang memilihnya.

Beliau tidak mentadbir Johor berasaskan suara majoriti, tetapi terus tunduk kepada kepentingan sempit golongan elit dan berduit.

Isu status pemilikan tanah Pulau Kukup, pemugaran hutan bakau untuk mendirikan kawasan riadah eksklusif golongan elit dan pengambilan tanah sesuka hati semuanya melanggar janji pilihan raya PH dan aspirasi rakyat jelata yang memilih PH pada 9 Mei lalu.

Saya juga tidak bersimpati dengan Osman kerana secara bersemuka saya telah bercakap sendiri dengan beliau ketika mesyuarat Majlis Pimpinan Tertinggi Bersatu dan beliau meyakinkan saya bahawa tuduhan ke atasnya adalah tidak benar.

Kita tidak boleh sekali-kali menerima dan melayan cabaran daripada golongan elit terhadap kerajaan yang dipilih oleh rakyat.

Panduan Sejarah

Tiba-tiba pemikiran “kejam” saya membawa saya kembali ke masa lampau untuk melihat bagaimana pemimpin terdahulu menangani krisis negeri, khususnya cabaran terhadap kuasa Kerajaan Pusat.

Hal ini berlaku di banyak negeri yang melibatkan perebutan kuasa di kalangan kelompok yang diamanahkan untuk mentadbir.

Sebagai negara persekutuan, Kerajaan Pusat mempunyai hak untuk campur tangan. Dalam kes ekstrem ia boleh mengisytiharkan darurat bagi menjamin atau mengembalikan ketenteraman awam.

Inilah yang dilakukan oleh Almarhum Tun Hussein Onn pada tahun 1977 apabila Kerajaan Pusat mengisytiharkan darurat dan mengambil alih pemerintahan negeri Kelantan.

Statut Rom

Berkenaan Statut Rom (Undang-undang Rom) mengenai jenayah terhadap kemanusiaan seperti pembunuhan beramai-ramai, saya menggesa kerajaan agar menimbang semula keputusan untuk tidak menyertainya.

Kalau Raja-raja bimbang yang mereka akan dilibatkan, kita boleh pinda Perlembagaan untuk tidak membabitkan mereka dalam hal-hal yang boleh membawa kepada tindakan di bawah undang-undang antarabangsa itu.

Dalam beratus tahun sejarah ketamadunan kita, sudah berapa kali kah kita melakukan jenayah seperti yang tersenarai dalam statut itu?

Yang kita tahu, jenayah seperti itu yang terjadi di negara kita dilakukan oleh bangsa-bangsa penjajah. Pembunuhan Batang Kali misalnya.

Tapi dengan kita tidak menganggotai konvensyen antarabangsa seperti Statut Rom kita secara sengaja memberi gambaran bahawa kita mencurigai kemampuan kita untuk tidak melakukan kekejaman secara sistematik.

Kalau kita hendak menjadi anggota masyarakat antarabangsa, kita tidak boleh tunduk kepada tekanan minoriti atau oleh golongan berkepentingan.

Kalau ada tekanan atau bangkangan, kita wajib mengatasinya melalui rundingan atau kita pinda perlembagaan supaya sumber bantahan dan ketakutan itu dihapuskan.

Seandainya benar Raja-raja kita bimbang mereka akan dipertanggungjawabkan, Parlimen boleh meminda Perlembagaan agar bidang kuasa mereka tidak mencakupi peruntukan Statut Rom.

Kita ada pakar undang-undang dan perlembagaan taraf antarabangsa. Mengapa harus kita serah ketamadunan dan kemanusiaan kita kepada empat orang pensyarah universiti yang ramai kita tidak pun kenal?

yes, Tun Dr M is right to accept members of the opposition parties to form part of the govt to get a two thirds majority.
Sabah and Sarawak opposition members killed their own chances to be recognised as separate states in Malaysia, from the Malayan states.
History will record the opposing MPs' betrayal.
History will also record that the PH govt tried to initiate the steps for their recognition, and future generations will respect the PH govt to keep to the PH manifesto.

It is certainly no loss to the PH govt, in fact this "defeat" makes it easier for the PH govt to govern Sabah and Sarawak. Sabah and Sarawak will continue to be lumped together as Malayan states until such time the Federal Govt re-introduces the bill again.

the rakyat is looking forward to the welcome and good news that the tenure of the current Chief Justice is being extended.

Do not keep us waiting too long to get this news.

Bagi saya isu Pulau Kukup ini, sudah cukup alasan untuk MB Johor resign.

Berkenaan dengan statut Rome ini, bagi rakyat Sabah dan Sarawak, adakah ini menjadi masalah?

Saya rasa tak menjadi masalah kerana wilayah Sabah dan Sarawak tak ada raja.

Oleh itu bolehkan kita buat kesimpulan sebenarnya, yang jadi isu adalah berhubung-kait dengan kepentingan raja-raja, bukan kepentingan rakyat.?

4 orang akedemik menulis untuk kepentingan raja-raja atau kepentingan rakyat?

Saya setuju dengan DAKJ, kalau Raja-Raja khuatir kemungkinan mereka akan dipersoalkan atau dipertanggung-jawapkan oleh mahkamah ICC, perlembagaan boleh digubal untuk atasi perkara ini.

Kepentingan rakyat adalah, kita mahukan negara Malaysia menjadi sebahagian dan memainkan peranan dalam badan dunia.

Kita mahukan ICC untuk meneruskan adili kes MH17 yang ditembak oleh penjenayah. Mana boleh kita biarkan kapalterbang sivil kita ditembak begitu rupa.? Kita mahukan keadilan ini di mahkamah antarabangsa kerana kepentingan rakyat.

Malaysia adalah sebuah negara kecil dan bukan negara besar dan kuat seperti negara China, Amerika dan Rusia.

Untuk kepentingan rakyat Malaysia, kita perlu bersama-sama dengan negara lain di Asean, dan di PBB supaya kepentingan kita di dunia ini terbela.

Orang melayu jangan lupa, tanah melayu diserang oleh Jepun pada Desember 1941 dan tak sampai 2 bulan, Tanah Melayu jatuh ke tangan Jepun. Kedah, Kelantan, Perlis dan Terengganu menjadi wilayah Thailand Selatan.

Jadi itu, janganlah kita sombong dan berfikir kita cukup kuat dan kebal dalam dunia ini.

Saya agak sedih juga, pindaan perlembagaan untuk Sabah dan Sarawak tak berjaya. Sekarang ini, orang Sabah dan Sarawak baru tahu yang mana betul dan tak betul.

Malaysia can accede to all the international laws that we want, but it will only be a mockery and hypocrisy if the government practices selective prosecution when it comes to its own domestic laws. A good example is the case of the former CM of Penang whose ongoing corruption court case was dropped immediately after PH became the government after GE14.

Osman Sapian can letak his MB post for all we care. He is a sycophant of you know who!

What is more important to us the rakyat is that we are anxiously waiting for the confirmation that the Chief Justice Richard term and the other deserving Federal judges have been extended.
In this time of turmoil, they are the bright sparks of justice.

this is a well reasoned article written by Dennis Ignatius, Malaysia's former ambassador, and the extract which has full pertinence on the Rome Statute:

" Like many Malaysians, I am utterly dismayed, even disgusted, with the way Malaysia’s accession to the Rome Statute, the treaty which established the International Criminal Court (ICC), has been deliberately and maliciously distorted to embarrass the administration of Prime Minister Dr Mahathir Mohamad.

It is shocking to hear a man who has committed his whole life to serving our nation being called a traitor, among other things.

It’s okay to disagree with him but to call him a traitor is to cross the line of civility and common decency. It is vulgar, shameful and unwarranted. "

Hope the guilty ones feel ashamed of what they deliberately trumpeted regarding Tun and the Rome Statutes.

failure of the opposition MPs to support the move to amend the constitution bill to designate Sabah and Sarawak as separate states, is like what the Sabah government’s adviser on Malaysia Agreement 1963 (MA63)to the Sabah govt Zainnal said, a horror show:

“What the Sabah and Sarawak MPs should be doing is to grab what they can, not ask for new stuff again and again.

“A bird in the hand is worth two in the bush but in the end, even that bird flew away because these MPs were too busy looking for the two in the bush,” he said.

On demands that the federal government also amend Article 160(2) that interprets the word ‘the Federation’ as ‘the Federation established under the Federation of Malaya Agreement 1957’, Zainnal said it should not be brought into the equation at the moment.

Amending Article 160(2), he said, is a new bill altogether since it was not even changed or touched upon in 1963.

Nancy Shukri will rue the day she and the others who did not vote. You are the ones who betrayed Sabah and Sarawak.
When you have a toehold in the door, it will surely open. Now it is completely shut and locked. Pity them.
If ever the opportunity is given again by the ruling PH govt, for goodness sake don't bicker and argue, grab it with both hands, then after it is passed they can make more noise.

Just a few days ago, PH had discarded its first ever rotten apple out of the office. But, today, it is totally a different story. Tun has presented us the apple of his eye in the august House, tabling the scandalous Felda White Paper, beaming with pride and a flawless demeanour throughout. His speech, thundered and spilled out all the hideous deliberate cover-ups that had been kept in the dark, echoed with countless of 'hooo...haaa...' reactions for the whole sitting. It was one of the best hearings after PH came to power.

What I foresee now, DSAA is by far the best and right choice of Tun's pick, to be seated as DPM. And, maybe PM-8. Why not? At least, he is in his prime and his track record shows not only 'uncontaminated' but excellent, I suppose. Most importantly, Tun seems to have established an amicable and close working relationship with him. That is the key point.

Apa yang pasti... kemelut MB Johor ini akan meramaikan lagi golongan pembenci-monarki atau Monarcy haters... yang paling bahaya dari kalangan orang-Melayu.

Mana tidaknya, akibat pihak-Istana bermain-politik, habis terburai pekong yang sekian lama disimpan begitu rapi oleh pemerintah politik.

Bekas Anggota TLDM yang pernah berkhidmat di MBJ (Malaysian Base Jetty) Woodland Singapura, sekitar 1984, sudah tentu tidak akan lupa terhadap penghinaan menimpa Pegawai atasan mereka.

Wee Ka Siong is playing a very dangerous game, he should be reported to the police for incitement, trying to put the monarchy against the federal govt.
There should be no confusion over the appointment of the Johor mentri besar if all parties followed the state constitution, says MCA president Datuk Seri Dr Wee Ka Siong.
Ka Siong, go read up the federal constitution, or keep quiet, just go and retire in Johore.

Putrajaya already has a possible replacement in mind for outgoing Chief Justice Richard Malanjum, who is slated to retire tomorrow.

Prime Minister Dr Mahathir Mohamad said that his government already has a candidate in mind, but declined to name the person.

Tun, please listen to us. We are absolutely disappointed if this is the case.
CJ Richard Malanjum tenure should be extended for another 2 years. He has performed excellently in the pursuit of justice without fear or favour, he just started his work not too long ago because the previous regime extended the previous CJ who in many eyes was defiitely not up to the mark.

Please extend CJ Malanjumm that is our plea.

Missing RM9 billion ? said...

Datuk,
Putrajaya today announced a reduction of RM21.5 billion in construction cost for Phase 1 and 2 of the East Coast Rail Link (ECRL) project.

It said the cost of construction for these phases was reduced from RM65.5 billion to RM44 billion following the signing of a supplementary agreement (SA) between Malaysia Rail Link Sdn Bhd and China Communications Construction Company Ltd.

“(This) will pave the way for the resumption of the ECRL project,” the Prime Minister’s Office said in a statement today.

Surely, the figure of Rm44 billion is still way way too high!
It was earlier said by the Minister of Finance Lim Guan Eng negotiations were going well, and that the project would continue if the cost of construction could be reduced to RM35 billion. This is confidence that the Chinese counterparts would agree to this reduction.
So what happened to the "missing" RM9 billion? Into someone else's pockets?
Where or where can the little red riding hood hide?
Don't let there be another scandal, even RM9 billion is more than the rakyat can stomach. You can bet this will not go down well with the rakyat.

Osman Sapian is a one man clown.
First he resigns, then he says he's technically still the MB until he has seen the Sultan, then after the audience he says the Sultan had not looked at it and was holding on to his letter for souvenir, that the Sultan laid some conditions to revamp the exco before appointing a new MB, that he has another meeting with the Sultan at 6.30pm
He is certainly a mine of information, "dragging" the sultan into this and that.

Before any further revelations are made by Osman, did it precipitate a statement from
the Sultan's office that Osman's resignation was accepted at 10am, and that the new MB would be appointed the very next morning. No mention of the conditions.

Interesting to see further developments.

Pertama, saya cukup kecewa bila komen saya yg ikhlas untuk berpesan-pesan kepada kebenaran, Dato’ buang dalam tong sampah begitu saja. Dato’, memanglah ubat itu pahit untuk ditelan. Tapi kalau tak diambil, sakit jadi melarat. Tapi tak apalah, blog ni Dato’ yg punya. Hak Dato’ nak siarkan apa yg sedap-sedap dibaca sahaja. Saya hormat.

Kedua, PH kalah lagi di PRK Rantau. Kali ini amat significat sebab orang Melayu hanya 50% sahaja. Kalau diikutkan, PH boleh menang jika undi Melayu berpecah. Tetapi sebaliknya terjadi, bukan sahaja undi Melayu solid kpd UMNO, katanya, PH hanya menang di Kawasan cina je, kawasan India pun kalah. Hehehe……… Alamatnya, kerajaan sepenggal makin jadi kenyataan lah ye……….

Ketiga, bila seseorang tu dah jatuh, kita tidak mengunkit lagi keburukan dia. Cukuplah. Target kita nak turunkan mereka je semata-mata utk mendapatkan pemimpin yg lebih baik. Kenapa pula kita nak membuka aib orang yg dah jatuh. Dulu Najib, sekarang MB Johor pulak. Nampaknya, Dato’ masih tak faham-faham apa isi hati orang Melayu sebenarnya. Bila saya tegur, Dato’ buang dalam tong sampah. Dah macam mana ????

Akhir kata, ikutlah Dato’ nak siarkan ke tak sebab blog ni Dato’ punya. Cuma satu je pesan saya, manis itu racun, pahit itu penawar. Sekian TQ.
